The allowable coats of the project shall not include any coats determined by the FPA to be ineligible for consideration as to alleumbility under Title 49 U.S.c. 3. Payment of the United States share of the allowable project costs will be made pursuant to and i accordance with the provisions of such regulations and procedures as the Secretary shall prescribe. Final determination of the United States share will be based upon the final audit of the total anoint of allowable project < and settlement will be made for any upward or downward adjustments to the Federal share of costs. 4. The sponsor shall carry out and complete the Project without undue delays and i accordance with the terms hereof, and such regulations and procedures as the Secretary shall prescribe, and agrees to comply with the assurances which were made part of the project application. 5. The F 1 reserves the right to amend or withdraw this offer at any time prior to its acceptance by the Sponsor. 6. This offer shall expire and the United States shall not be obligated to pay any part of the costs of the project unless this offer has been accepted by the sponsor on or before July 2, 2004, or such subsequent date as may be prescribed in writing by the FAA. 7. The sponsor shall take all steps, including litigation if necessary, to recover t Federal funds spent fraudulently, wastefully, or in violation of Federal an statutes, or sed in any other So up Sooner in any project on which Federal funds have been seconded. For the purposes of this grant agreement, the term 'Federal funds' me s funds however used or disbursed by the spnnsnr that w originally paid pursuant to thiso any chose Federal grant agreement. It shall obtain the approval of the Secretary as to any determination of the amount of the Federal share of such funds. It shall return the recovered Federal share, including funds recovered by settlement, order or judgment, to the Secretary. It shall furnish to the Secretary, upon request, all documents and records pertaining to the determination of the amount of the Federal share or to axle, settlemento litigation, negotiation, or other efforts taken to r such fonds. All settlements o other final positions of the sponsor, r curt o otherwiseinvolving the recovery of seen Federal share shall be approved in advance by the Secretary. S. The United States shall not be responsible or liable for damage to property or injury o persons which may arise from, or be incident to, compliance with this grant agreement. 9. Buy American Requirement: Unless otherwise approved by the F the sponsor will not acquire or permit any c actor o subcontractor to acquire any steel o manufactured products produced outside the United States to be used for any project for airport development or noise cou®atibility for which funds are provided under this grant. The Sponsor will include in every contract a provision implementing this special condition. The Sponsor's acceptance of this Offer and ratification and adoption of the Project Application incorporated herein shall he evidenced by ex cution of this instrument by the Sponsor, as hereinafter provided, and this Offer and Acceptance shall comprise a Grant Agreement, as provided by Title 49 O.S.C., constituting the contractual obligations and rights of the United States and the Sponsor with respect tthe accomplishment of the Projecta and compliance with the s and conditionsr as provided here . Teamed with the City of Bangor Engineering Department, Edwards and Kelcey provided design and construction administration phase services for the Deicing Fluid Collection System at the Bangor international Airport. The system was designed to use an existing stormwater trench drain to collect the runoff after deicing operations. A bituminous concrete berm was constructed around the proposed deicing area to ensure that the deicing fluid is contained within that area. Once the fluid is collected, itis then charred to eftherthe wastewater treatment plant orthe stormwater drainage system using a series of valves and ductile iron pipe. The volume of mnog collected by the system is monitored by electronic flow meters with a remote command center located inside the terminal building. The system has an oilMater separator and a 5,000 -gallon storage tank built In-line prior to discharging to either the sewage treatment plant or the stormwaler drainage system. The grant also includes engineering and administrative fees incurred by Me owner for project coordination and design, site inspection, environmentalsampling and analysis, advertising, and an independentfee estimate. (See Appendix t for a complete breakdown of the sponsor's Incurred costs.) ENGINEERING FEES: The grant also includes engineering fees for general consbuction administration, project administration during construction, and construction resident engineering costs. GEOGRAPHIC LOCATION Bangor In annadonal Airport is located just east of the central portion of the State of Maine in Penohscot County. The Airport is two miles from downtown Bangor and approximately 25 miles from the AOandc coast The primary service area of the Airport includes the cities of Buckspon, Old Town, Orono and other towns within a 301 mile radius. The secondary service area includes a much burger potion of 1he State since it is one of the State's two airports currently servicetl by carded! air driers and is a U.S. Customs portof-entry. The Airport also services supplemental air carvers.
