Responsible Department Commentary: The City has recently been approached by a group interestetl in working toward placing a monument on City property. Early in the process of discussing this proposal, the Transportation and Infrastructure Committee recognized the roti for a general policy to guide the city not only In reviewing this proposal, but for future proposals as well. As a result' a proposed policy was developed by staff and presented to the Committee for Its review. The group working on the current monument proposal also was involved in reviewing and commenting as well. As a result, the Committee recommends that the attached policy be adopted. The policy outlines our support for increasing the number of public monuments and public art pieces in the City; provides guidelines for public monuments and public art pieces; and outlines the approval process to be followed. Please note that a proposed citizen committee is included in this process. We anticipate that the City's cultural plan Wit provide a standing committee for this purpose. In the interim, however, a special committee may he required to process the pending project. I would recommend your approval. A Cm CI)MCM 24. 3004 Motto Rede evd Seconded for Passage Pass" CLBBR # 04-153 0 ROeR Moa meats Co be Located on Citq Peopett) Assigned to Councilor aad 04-153 GUIDELINES AND PROCEDURES FOR EVALUATING AND ACCEPTING PUBLIC ART AND MONUMENTS TO BE LOCATED ON CIT' PROPERTY 1.0 PURPOSE The purpose of this policy Is M insure that public art and monuments placed on public property are of high artistic merit, that the thematic material is appropriate for the City, and that the monument treats its subject matter with appropriate dignity. 2.0 GENERAL POLICY It is the general policy of the City of Bangor to support efforts to increase Me Oty's inventory of public art and monuments. Public monuments serve m recognize and memorialize people, events, and social trends that are important to the history of Bangor arxl M our sense of place as a community. Public Art serves to enhance the cultural and aesthetic quality of life and to add Interest and excitement to our community's public spaces. 3.0 GUIDELINES FOR PUBLIC MONUMENTS In determining whether a specific proposal for a public monument is appropriate, the following criteria should be considered: 3.1 The monument relates to persons or events recognized by the public as of sufficient significance to the community or its history as ro warrant a public presence. 3.2 The monument honors an individual, group of Individuals, event, or social trend that has a direct relationship to Bangor. 3.3 In the case of individuals, persons to be honored should have died a sufficient length of time in the past, generally at Wast twenty years, for their ideas, service, and accomplishments to be placed in an accurate and meaningfully Interpreted historical perspective. 3.4 The subject is of relevance to the community as a whole, not solely te a distinct segment or subset of the community. 3.5 The artistic merit of Me proposal, Including consideration of the suitability of the artistic theme to its subject matter. 3.6 If me subject Is Portrayed elsewhere in a public space, the proposal will present a different face of the subject and/or not detract from the existing monument. 4.0 GUIDELINES MR PUBLIC ART In considering whether a specific proposal far a public artwaric is appropriate, the artistic meat of the proposal shall be reviewed, including me suitability of the artistic theme M its subject matter and Its relevance to the community. 5.0 APPROVAL PROCESS -- CONCEPTUAL DESIGN When a proposal Is made, either by the Cry or a group whin the community, to erect a monument or artwork on public property owned or controlled by the City, the following review and approval process should be implemented. 5.1 The organization seeking approval for the monument or artwork shall submit an application to the City Manager. The application shall include a general discussant of the purpose of the work, the artistic format or medium W be employed, and the proposed location. In the case of a public monument, the application shall specifically address the crReria outlined] in Section 3 above. 5.2 The City Manager shall Inform the City Council of the proposal and shall forward it W appropriate City staff for review and comment and to the. designated dozen committee'. 5.3 The citizen committee shall review the proposal and make a recommendation to the City Council as to whether the general concept Presented should be approved] or denied]. For a proposed monument, the committee shall be guided by the criteria established in Section 3 above; for a proposed public art project, the committee shall be guided by the criterion established in Section 4 above. 5.4 Upon receipt of the committee's recommendation, the Council shall take formal action M approve or deny the concept as presented. 6 APPROVAL PROCESS— DETAILED DESIGN 6.1 Once conceptual design approval has been granted, the organization promoting the project shall submit a detailed proposal to the cul committee including a detailed descdptlon of the artvrodc or monument (accompanied by perspective drawings where appropriate), the location, budget, Ponding plan (including plans for a maintenance endowment), and plan for implementing the project, including a projected timeline. 6.2 The Committee shall Men review the design and the proposed] location to determine whether they are approPriate. In making this decision, the committee shall take Into account to following: 6.2.1 That the integrity of the artistic melt of the proposal as initially presented has been maintained as the proposal has been developed 6.2.2 The extent to which the work is consistent with Me public location selected and the surrounding natural and human landscape 6.2.3 Public safety and security ' It Is anticipated that a finding committee will be established at the time the Ory adapts a cultural plan. In Me interim, a special committee can be appointed as rtes m, te review any requests the are received. 0b 153 6.2.4 The level of ongoing maintenance that will be required by Me City and the estimate of the on-going or periodic costs likely to be incurred by the city for maintenance and upkeep 6.3 Upon completion of this review, the committee shall report its recommendations to the appropriate committee of the City Council. The citizen committee may recommend that the project be approved, be approved with modifcabons, or be denied. 6.4 The Council committee with jurisdiction shall then make a recommendation to the full Council on whether the project should be approved, approved with modifications, or denied. 6.5 The City Council shall Men take Me necessary action to formally approve or deny Me proposal, including adopting the necessary Council Order ro accept ownership of the monumentiartwark once completed and establishing Me amount required, if any, for a.malntenance endowment. FINAL DESIGN The organization proposing Me monument or artwork shall prepare final design document for submission to the dozen committee. These shall include details regarding materials, scale, site plan, design, and other information bearing on Me final project. The canmiitee must approve the final design of Me project. Prior to final approval, the committee shall seek Me ativice and recommendations of the Director of Infrastructure and Development Support the Chief a Police, and the Director of the Department with responsibility for the property on which Me monument/artwark is to be located. No work may begin until Me project has been approved by Me cozen committee and all required permits have been oblained. Prior to c mstruction, the proposing organization mus[: 8.1 Obtain all necessary licenses and permits for the project 8.2 Deposit with the City Me maintenance endowment if any, required by the City 8.3 Submit to the City all required design documents. Shop drawings and maintenance Instructors must be submitted as available and prior to final City acceptance. 8.4 Construction must be done in accordance with approved plans and petits. Minor modifications or deviations may be approved by Me Director of Infrastructure and Development Support. Other modifications mus[ be approved by Me citizens committee. 9 RESPONSIBILITY FOR REVIEW The Director of Infrartmctu a and Development Support shall periodically review this policy and recommend any required! changes.
