This Order would grant Robert Bull exclusive status as developer of a proposed restaurant on the
Waterfront development site located between the City's two parking Iota on Front Street mall July 26,
2004, The City would deal exclusively with Robert Baldscci for development of the site until July 26°.
Owing this period, Mr. Baldacci would have an opportunity to submit for the City Council's consideration
a specific proposal for development of building and other improvements on the site providing
commercial restaurant space. The Order squires the proposal to be in sufficient detail to allow the
Council to determine the level of investment and chamcter of the work to be performed.

development on this site for some time. Recently, he determined that the residential component of his
proposed call development is not feasible without designated and exClu Aca parking far potential
tenants. He has, however, expressed continuing Interest In a potential restaurant. He initially requested
an 1&momh tenbtive developer period. This was discussed at the Easiness and Economic Development
Committee. The Committee felt that 18 months was We long a period to encumber the property and
recommended a tinea -month period. The Committee recommends your approval.

WHEREAS, Robert E Baldaei, Jr. is Interested in developing a commercial restaurerlt
on a City owned development parcel located! on Front beet designated for restaurant /
entertainment use in the Bangor RiverparR on tie Penobscot Master Plan; and
WHEREAS, Robert E. Baldacd, Jr. requires time tip prepare a formal development
proposal for consideration by the City Coundl; and
WHEREAS, the City has granted! Rentative developer" status w Potential developers on
various City owned development sites in he past, thereby providing the developer time to
prepare a spedfic development proposal for the Cry CouncilY consideration and during which
time the City agrees to deal exclusively with the designated tentative developer for the purpose
for which tentative developer flatus was granted;
NOW, THEREFORE, BE R ORDERED BY THE CRY COUNCIL OF THE CITY OF
BANGOR THAT, Robert E. Saidacd, Jr. H hereby tlesignated the tentative developer of the
City owned development sire on Front Street located between the two City parking lots; Mat
