The purpose of this resolve is to approve the resolution of condemnation adopted on November 10, 2003,
as required by 30-A M.RS.A. § 5201 This is the second step in taking any remaining interests that might
east in the properties contained in Me Union Place Neighborhood Conservation Project community
development program by eminent domain. While the City already owns all of the properties affected, this
perimeter taking will clear all titles to ensure that no title problems arise in Me redevelopment phase.
Following approval of this resolve, the City will fie Me original resolve in Me Registry of Deeds and
Superior Court, file a motion to waive bond, and ativertise Me condemnation resolve in the BDN for 3
consecutive weeks. At the end of the 3 weeks, Me taking will be complete.
Since Me ownership interests to be extinguished are unknown, a person can daim an ownership interest
within the next 2 years and be entitled to compensation. The compensation is set at $1.00. The
Superior Court could decide to raise the compensation on Its own Initiative, but it is unlikely that it would
in this case.

proposals for its redevelopment.

Neighborhood Conservation Project.
WHEll Pursuant W Title 30-A 4 5204 and the City of Bangor's Union Place Neighborhood
Conservation Project, a community development program duly adopted and approvetl by
the Bangor City Council on July 26, 19999 by Counal Order 99-266, the Bangor City
Council adopted the attached Resolve of Condemnation affecting certain properties
located in Union Place, Bangor, and
WHEREAS, The City of Bangor owns all affected Properties and has been served a copy of this
Resolution, and the ownership of any other interests therein is unknown; and
WHEREAS, 30-A M.R.S.A. 4 5204 requires the Resolution W be submitted W the legislative body of
the municipality, for approval or disapproval following service of the Resolution on all
property owners;
,NOW, THEREFORE be it Resolved by the City Council of the City of Bangor as Follows:
(1) The Resolution of Condemnation of Property tnrated at Union Race Neighborhood
Conservation Project, Council Resolve 04-09, is hereby approved; and
(2) The following amounts approved in Council Resolve 0409 are hereby confirmed as the
full amounts of just compensation to the individuals named:

(TITLE.) Resolve, Resolution of Condemnation of Property Located at Union Place Neighborhood
Conservation Project.
WHEREAS, Title 30-A § 5203(3) authorizes Maine municipalities to acquire real estate located in
designated slum or blighted areas, for purposes of demolition or repair or redevelopment,
pursuant to a duly adopted Community Development Program, by purchase or eminent
domain; and]
WHEREAS, The following properties in Bangor are located within the Union Place Neighborhood
Conservation Project, a "slum or blighted area" designated az a community development
program by the Bangor City Council in Council Order 99-266, posted July 26, 1999: 243
Union Street, 245 Union Street, 251 Union Street, 253 Union Street, 8v Union Place, 10
Union Plate, 12 Union Place, 15 Union Place, 16 Union Place, ] Union Place, t I Union
Piece, and the Union Place right-of-way; ring
WHEREAS, The City of Bangor has acquired all properties within this Union Place Neighborhood
Conservation Project and desires to clear the titles thereto to facilitate redevelopment; end
WHEREAS, This Resolution of Condemnation is adopted by the City Council of the City of Bangor,
acting as municipal officers pursuant to 30-A M.R.S A. § 5204(1);
NOW, THEREFORE, By the City Council of the City of Bangor be it RESOLVED AS FOLLOWS:
(1) Union Place Neighborhood Conservation Project, a community development program
encompassing the following properties and further described by metes and bounds in
"Schedule A" attached hereto is hereby condemned and acquired in we simple absolute by
the City of Bangor pursuant to 30-A M.RS.A. § 5204 end the City of Bangor's duly
adopted Union Place Neighborhood Conservation Project community development
