Residence Two District and Urban Service District to Multi -Family and Service District for a 2.93 acre
parcel located at 315 Harlow Street.

amended as follows:
By changing a parcel of land located at 315 Harlow Street (Tax Map Na.
40, Parcel No. 12) from Urban Residence Two District and Urban Service
District to Nulti-Family and Service District. Said parcel containing
approximately 2.43 acres and being more particularly indicated on the
map attached hereto and made a part hereof.

MEMORANDUM

SUBJECT: Amending Zoning Ordinance
315 Harlow Street
Council Ordinance 06-359
Please be advised that the Planning Board at its regularly scheduled meeting on
November 7, 2006, held a public hearing on the above zone change request.
Julia Wilcock of Volunteers of America, (VOA) Northern New England indicated
they were seeking to rezone the existng commercial building on Harlow Street to
Multifamily and Service District fivil such that it could be replaced and developed as
assisted elderly housing.
Mr. Jeffrey Aceto, PE of Sitelin rs, indicated it was Volunteers of America's
concept to place their new residential building adjacent W Harlow Street within the area
that is Presently zoned Urban Service District. Mr. Aceto indicated he understood the
Planning Office's concern with rezoning the entre parcel to MBSD and they were
agreeable to a conditional approval that would limit the use of the upper portion of the
site.
The Planning Staff indicated that the property is presently in two zoning districts
Urban Service District (USD) on the Harlow Street portion and Urban Residence 2
District (URD -2) on the upper Curve Street portion. The Comprehensive Plan Zoning
Policy Map identifies Mese two areas as ideally suited to USD and URD -2 respectively.
The Comprehensive Plan addressed the redevelopment of this property and anticipated
a mix of commercial and residential uses. The Planning Staff has no concern as to the
change In the commercial portion of the site to the Multifamily and Service District but
does have some concern in expanding the higher density district into the Curve Street
and Market Street area that is predominately zoned URD -2. The higher densities and
potential for large scale buildings would be a departure from the City's existing
development plan. Staff supports the V0A redevelopment concept and is open to
flexibility as to where the exact line is but wants to be dear that the City zoning runs
with the land and Is not specific to Me present proposal.
After a brief discussion with the applicant and the options available to the Board
at this time, the Board voted one in favor and four opposed to recommend the City
Council adopt CO#06-359. The Board then voted unanimously to recommend the City
Council consider an alternate proposal rezoning the Urban Service District to Multi
family and Service District leaving the Urban Residential 2 District unchanged
(represented as C. O. 06-359 As Amended).
