regularly updated as Building Code m me most recent published edition.
BOCA, the regional ode which the City has historically adopted, has merged with the ower two
regional code aumoriliestofomh the International Code Coundl and has produced the International
Code series which Is recognized by local and sfategovemmen[s, clesigners and professionals. This
will be me third edition of me IBC me CRY has adopted since the merger of the three ode
authorities. The 2006 edition replaces me 2003 edition.

(TITLE.) Ordinance, Amending the Cade of the City of Bangor by Deleting Chapter 81,
Building Code, and Replacing It with New Chapter 81, Building Code.

Section 1
The Code of the Cary of Bangor Is hereby amended by deleting and repealing Chapter 81, Building
Code.

The Code of the City of Bangor is hereby amended by adding thereto a new Chapter, to replace
Chapter 81 hereinabove repealed, W be Chapter 81, Building Cade, as follows:
§ 81-1. Adoption of Code.
In accordance with 30-A M.R.S.A. § 3003, as the same may be amended from time to time, the
International Building Code 2006, -published by the International Code Council, Inc., is hereby adopted
and incorporatetl by reference herein as Me minimum standard for the conetuction, akeration,
addition, repair, removal, demolition, use, location, occupancy, and maintenance of all buildings and
structures and their service equipment, both existing and proposed, located within the City of Bangor,
§ 81-2. Amendments.
Said Building Code is adopted in its published form as "t fully set farm herein, except as follows:
A. Section 101.1 is deleted and replaced with the following:
101.1 This: These regulations shall be known as the "Building Cade of the city of Bangor,"
hereinafter referred to as "this ccde."
B. Section 103.1 and 103.2 are deleted and replaced with the following:
103.1 Code official: Further references in this ode to the "code official" shall be interpreted to
mean the Chief Code Enforcement Officer of the City of Bangor.
C. Section 105. 1.1 and 105.1.2 are deleted and replaced with the following:
105.1 By whom application is made: Application for a permit shall be made by the owner or
lessee of the bulking or structure, or agent or either, or by the licensed engineer or
ardritect employed in connection WM the proposed work. The full name and address of

the owner or lessee, the applicant, and of the responsible officers, if the owner or lessee is
a corporate body, shall be stag in the application.
D. Section 108.2 is deleted and replaced with the following:
108.2 Fere sdw=dule: Fees shall be paid to the City of Bangor in accordance with the schedule set
forth in dwpter 109, Fees, Al I, Code Enforcement Permits, of the Code of the City of
Bangor.
E. Section 113.4 is deleted and replaced with the following:
113.4 Violation penalties: Penalties for violations of this code shall be imposed in accordance with
31l M.R.S.A. §4452, as the same may be amended from time to time. Each day a violation
shall be permitted to exist after notification by the Chief Cade Enforcement Officer shall
constitute a separate offense.
F. Section 114.3 is deleted and replaced with the following:
114.3 Unlawful continuance: Any person who shall continue any work in or about the structure
after having been served with a sto"ork order, except such work as he or she is directed
to perform to remove a violation or unsafe conditions, shall be guilty of a violation of this
code.
G. Section 115.1 is deleted and replaced with the following:
115.1 Vacating structures: In add@ion to the enumerated circumstances in the International
Property Maintenance Code 2000, or subsequent amendments thereto, the Code
Enforcement Officer may order an immediate vacating of any part of, or all of, a structure
which loses its source of heat, cooling, hot water, water supply, or sewer service or has
malfunctioning electrical service or has been substantially damaged due to fire or natural
disaster. When, in the opinion of the code official, there is actual and immediate danger of
failure or collapse of a structure which would endanger IHe or when any structure has fallen
and life is endangered by the occupancy of the structure or when there Is actual or potential
danger to the building occupants or those in the proximity of any structure because of
explosives, explosive fumes or vapors, or the presence of toxic fumes, gases, or materials
or use of defective equipment, the code official is hereby authorized and empowered to
order and require the occupants to vacate the premises foMwith. Tice code official shall
cause to be posted at the main entrance m such structure a notice reading as follows: "This
structure is unsafe and i6 use or occupancy has been prohibited by the code official." It
shall be unlawful for any person to enter such structure except for the purl of securing
the shuatiire, making the required repairs, removing the hazardous condition, or
demolishing the structure.
H. Section 112.2 Is deleted and replaced with the following:
112.2 nomination for appeal: The owner of a building or structure or any other person may make
an appeal to the Board of Appeals, as established by Chapter 23, Article I of the Code of the
City of Bangor, from a decision of the code official refusing to grant a modification to the
provisions of this code covering the manner of construction or materials to be used in the
erection, alteration or repair of a budding or structure. Such appeal shall be commend by
following the procedures set forth by Chapter 23, Article I of the Code of the City of Bangor.

1. The following sections are deleted in their entirety: 112.1 and 112.3.
3. Section 312.1 m deleted and replaced with the following:
312.1 General: Buildings and structures of an accessory character and miscellaneous structures
rat classified in any specific use group shall be constructed, equipped, and malntairretl to
conform to the requirements of this code commensurate with the fire and life hazard
inddental to their occupancy. Use Group U shall induce fences, tanks, cooling towers,
retaining walls, and buildings such as private garages, carports, sheds, and agricultural
buildings.
K. Section 907.1 is deleted and replaced with the following:
907.1 General: No burglar and other emergency alarm described in Chapter 58, Alarm Systems,
Article I, Burglar and Emergency Alarm Systems, of the Code of the City of Bangor shall be
installed! and operated in any structure unless the same shall be installed and operated In
compliance with the National Electolcal Code In effect in the City of Bangor at that time and
unless the alarm user possesses or has been issued a valid permit pursuant to Chapter 58,
Article I of the Code of the City of Bangor.
