There is no longer arty need to retain this porton of Buck Street as a public way and discontinuance Is necessary to accommodate the proposed development. pursuant to Coundl Order 06289 the City Engineer gave notice of the proposed discontinuance and held a public hearing. This Order will accept the City EngineeYs report and discmrtinue that portion of Buds Street southeasterly from Main Street. ORDER, Authorizing the Discontinuance of Buck Street— Southeasterly of Main Street WHEREAS, the southeasterly porton of Buck Street was accepted As a public way on December 1, 1836; and WHEREAS, the section of Buck Street from Main Street extending snutheasterly toward the Penobscot River is wiMin the proposed development footprint of the Racine Gaming Facility Mat Bangor Historic Track, Inc. plans W develop; and WHEREAS, Bangor Historic Trark, Inc. has acquired some property rights within the proposed development footprint and has contracted to acquire the remaining property rights; and WHEREAS, said patient of Buck Street and the public easements contained therein are no ."at necessary to serve the public needs. This action is being pursued in order to accommodate the Radno Gaming Facility that Penn National plans to develop. The proposed discontinuance Involves a portion of street right-of-way that has not been utilized for public purposes for many years. Notice is hereby given that in pursuance of City Council Order No. 06-284 passed August 14, 2006 directing the City Engineer to discontinue a portion of Buck Street as outlined above and in accordance with 23 M.R.S.A. 43026, the City Engineer will hold a public hearing on September 25, 2006 at 9:00 a.m. EDT in the Engineering Conference Room, City Hall, 73 Harlow Street, Bangor, Maine to consider discontinuance of said street and determine the damages or benefits, if any, sustained by any party as a result of this action, apportion same, If any, according to law, upon the Ids or parcels of land damaged or benefited by such discontinuance.
