Responsible Department: City Manager Commentary: In March, Me City Coundl adopted an ordercondemning the building M 53 Charles Street. The owner, Norumbega Venture Capital, LLC, was ordered to secure the property, and remove debns within 30 days aM to either demolish or renovate the structure within 90 days. If cen inuous progress toward renovations were made but the project was not completed within 90 days, up W three additional thirty day extensions could be granted If there was also a showing of praofoffinandalrapabiliryWmmpletethework. Some initial progress was made on securing and removing debris and renovating the paper y. This work has stalled and is substantially incomplete. Both the City and the owner's legal representative have been unable to locate the owner recently, and Norumbega Venture Capital, LLC is no longer an ache corporation in the State of Maine. Ills apparent that the current ownership has failed to meet the conditions set forth by the Council and appears unlikely M have the financial resources M do so In Me Immediate future. As a result, the City's only option Is to proceed with demolition of the property. This resolve will appropriate Me necessary funds for this purpose. After the work is performed, the City will pace a lien on the property and attempt M recover our costs at some pant in the future. Please be advised, however, that recovery is highly unlikely. We also Intend M notify the owner and various mortgage holders of the Citys intent to proceed M demolish the property. Our intention is to demolish shortly after September 1P. Public Works has prepared a demolition estimate of $29,480 (armored). The Fire Oeparmnent has reviewed the property and believes that it may he appropriate to use as a live burn training exercise, an option Mat would reduce the cost significantly. Since the final demolition option has not been determined, Me attadled Resolve will appropriate $30,000 forthis purpose with language that will return any unspent amount to the Capital Reserve after project completion. Resolve, Making an Appropriation for Purposes of Demolishing 53 ILeclesjutr. . t WHEREAS, on Mardi 13, 2006 by Council Order 06-113, the Bangor City Council Condemned the structure/building located at 53 Charles Street; and WHEREAS, pursuant to that action, the property owner, Norumbega Venture Capital, LLC, was given thirty days to secure the structure and remove debris and other refuse and ninety days to either renovate or remove the structure; and WHEREAS, after some initial progress, work on the property has not continued at an acceptable pace and the structure remains unsafe, unstable, a fire hazard, unsuitable or improper for the use or the occupancy as a residence; a hazard to health or safety, and dangerous to life and property; and WHEREAS, given the failure of Norumbega Venture Capital, LLC to undertake the necessary work, it is now necassarydor the City to demolish the structure; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BANGOR THAT " The following amounts are hereby appropriated for the purposes of demolishing the property and removing and disposing of any personal property remaining in the structure or on the property: $5,900 in unbudgeted revenue resulting from the sale of the property located at 58 Court Street; and $24,100 from the Capital Improvement Reserve. BE IT FURTHER RESOLVED THAT The Finance Director is authorized to establish the necessary capital account for this purpose and, at the completion of the project, to return any unexpended balance to the Capital Improvement Reserve.
