Amending Zoning Ordinance
1379 Hammond Street
Council Ordinance 06-260
Please be advised that the Planning Board at its regularly scheduled meeting on
July 10, 2006, held a public hearing on the above zone change request
Attorney Andrew Hamilton representative of the applicant indicated they were
seeking to change the zoning to Government and Institutional Service District to
accommodate the expansion of the Pine Grove Cemetery in coordination with the City
such that Pine Grave Crematorium could construct a non profit community crematorium
at this location.
Mr. Norman Martell indicated he had several questions about the potential
impact of the new facility on the residents of his 30 -unit mobile home park Mr. Martell
was concerned about property value impacts, access and utility Issues land use policy
Issues, and operational oversight There were no other proponents or opponents.
The Planning Officer noted while there were several issues regarding State
regulations and the Citys Land Development Cade related to this use, the basic land
use policy question seemed fairly straight forward. The 2005 Comprehensive Plan
update recognizes cemeteries as an Institutional land use. Any expansion of an existing
cemetery would warrant expansion of the related Government and Institutional District
Given the clear intent on the part of the applicant In its agreement with the City, and its
intent to establish Itself as a nonprofit operation this is a reasonable expansion of the
district. Secondly, the area being changed is a heavy industrial district which could have
far greater Impacts than what could occur in the proposed 1.7 acre change.
After careful consideration of the existing uses in the area, and the proposed
land use in the Comprehensive Plan, the Board voted unanimously to recommend the
proposed zoning change.
