Commentary:
Bangor and Brewersharea Hovercraft Rescue Vehkle (HRV) acquired with Homeland SecuntylFundsthrough
the Maine Emergency Management Agency (MEMA). `Mien MEMA provides the funds and equipment that
are used jointly by municipalities, they require a Memorandum of Untlerstanding between the municipalities
and MEMA.
The HRV will be maintained Jointly by Bangor and Brewer. It will be kept In Brewer. The HRV will be
available for each municipality and for responses to other communities pursuant to mutual aid
agreements.
This Order authorizes execution of an agreement between Bangor and Brewer
Department Head
The Government Operators Committee recommends approval. By way of background, the City of
Bangor initially requested homeland security funding for a boat to be used for water rescue. At Me same
time, Brewer requested funding for the hovercraft. MEMA Indicated that they, would fund one project and
suggested that the Cites cooperate in this venture. �. ,� ,

(RRE.) ORDER Authorizing Execution of Memorandum of Understanding with City of
Brewer - Hovercraft Rescue Vehicle
WHEREAS, the City of Bangor and City of Brewer share a Hovercraft Rescue Vehicle
(HRV); and
WHEREAS, said HRV was acquired through the Maine Emergency Management Agency
(MEMA) with Homeland Security Funds; and
WHEREAS, a Memorandum of Understanding is required by MEMA when R provides
funding and equipment that is to be used Jointly by municipalities;
NOW, THEREFORE, BE IT ORDERED BY THE CIT' COUNCIL OF THE CITY OF BANGOR
THAT
the City Manager is hereby authorized to execute a Memorandum of Understanding
between the City of Bangor_and City, of Brewer In a form substantially the same as
attached hereto. Said Memorandum of Understanding shall be in a final form as
approved by the City Solicitor or Assistant City Solicitor.

Fauiomeot: The HOVERGDARD 10M model met with agreed accessories, in specified in
Appendix A, will be pmctased by Maine EmergencyMmaganrnt Amoy's (MEMA) Homebred
SecurityChant Program funding. The City ofBmgm and the City of Brewerwill retainjoint
ownashtpofthe HRV.
Maintenance: neCityof Bangorand CityofBrewer agreemequallyslowilexpenuinthe
maintmance and protection ofthe equipment, including but not limited to registration, insurance,
routine testing, cleaving and inspection. Outlays for repair and/or maintenance shall be
approved by the Fire Chief of each municipality's Fire Department, or his designee, in advance.
Brewer Fire Department by virtue of accessibility agrees to provide daily/weekly maintenance as
required. For major repairs, the Bangor Fire Department's mechanic will complete or coordinate
repairs as needed. "In Kind" efforts will not supplant actual expenses.
Std The City of Brewer will provide heated housing in the Brewer Fire Station at at a
facility mutually agreed by both Fire Chiefs.
Training: Bangor and Brewer agree to conduct refresher training at least= natty to evaluate
their stares and training needs. Coordinated joint training should be considered yearly, but
should not prohibit additional facing by either municipality's fire department. Initial training
shall include one factory brined operator from each department to serve as in baase trainers.
Emeumary Response: no HRV will be available for emergency response under the terms of
existingmumal aid commands. For incidents on the Penobscot River, the City oforigin may
assume Command and control ofthe vehicle. Furthermore, incidents on the Bangor side of the
Penobscot Rivuwill mepme Brewer Fire Department to respond the HRV to the Bangor Docks
or as directed by Bangor Command.
Planed Evenb: BmprmdBrewmwillccordiruteuuofthe HRVf plmmedcvmtsinthcn
respcctive communities. Some of these events include: Kenduskeag Stream Canoe Race, Folk
Festival, 4Is of July Fireworks and/or others to be named. The host community will assume the
responsibility for staffing.
Regional Emergency Response: When possible pas determined by the on duty Commanding
Officer of the Department receiving a request) the Bangor/Brewer HRV will be available for
regional emergency, response. The requesting agency may be responsible for the expenses
mended including transportation, fuel, and labor costs. Compensation rates for labor and

materials expended during operations will be assessed according to the Federal Emergency
Management Agency (FEMA) Schedule ofEguipment Rates (www Fane coy/rm/os/fin an

Return to Service: Upon completion of my we the responsible depmnnent will recent the HRV
ready for emergency, response. This includes properly cleaned, fueled, and inventoried. Any
deficiencies should be immediately rep red.
Third Party Beneileiarle: This Agreement is for the benefit of the City of Bangor and the City
of Brewer and is net intended to ince to the benefit of any third party, including but not limited
to any particular municipality or group of emergency responders.
Term: This Agreement will remain in hall force and effect our the service life of me HRV or
wail terminated by either side by written notification. If either Bangor or Brewer reminder
thew participation in this Agreement, the remaining party will return the Hovercraft asset This
