Item/Subject: Order, Discontinuing a Portion of Webster Avenue S

The City recently received a request from Galen Cole W discontinue Me portion of Webster
Avenue between Interstate 395 and perry Road Acopy of Cole's letter is attached Mr. Cole
owns property on bon sides of this section of Webster Avenue. He would like W expand the
commercial building located at 359 Perry Road, but Me front yard setback requirement from
Webster Avenue severely limits his opportunity to do so.
This portion of Webster Avenue has been blacked off from regular public use for many years.
Accordingly, there appears to be no need to retain Has a public way, provided Mata reservation
is retained for possible future trail and necessary golf course uses.;
The attached Order would tired We City Engineer to start the discontinuance process Mat is
prescribed by Maine State Statutes. Subsequently, the City Engineerwould notify abutters,hold
a public hearing, and submit a written report and recommendation to the City Council for Final
Adler.

CITY OF BANGOR
(TITLE.) Order, Authorizing Discontinuance of a Portion of Webster Avenue
WHEREAS, the southwesterly portion of Webster Avenue was accepted as a public way October
2, 1923; and
WHEREAS, the section of Webster Avenue extending through the Municipal Golf Course toward
Perry Road has not been used for public vehicular travel for marry years; and
WHEREAS, the owner of property located on both sides of Webster Avenue between Interstate
395 and the Perry Road has requested discontinuance of that portion of Webster
Avenue; and
WHEREAS, said portion of Webster Avenue is no longer necessary to serve the public need;
NOW, THEREFORE, BE R ORDERED BY THE CITY COUNCIL OF THE CRY OF BANGOR that the
City Engineer be and hereby is directed to begin the process of discontinuing the portion of
Webster Avenue between Interstate 395 and the Perry Road In accordance with 23 M.RS.A.
§3026 and submit a written report to the CSty Council for further action.
