This Order authorizes the City Managerto execuman easementto are an accidental setbackviolation forlot
17 of the Sussex Pines Subdimston, which is being developed by the Bangor Housing Development
Corporation. The lot Is on the corner of Starling Drive and Cardinal Way and is required to meet two front
yard setbacks. Thes[nrcture was erroneously constructed 3 W 4 hetcloserto Cardinal Way than allowed by
the front yard sedeack Cardinal Way has notyet been accepted "a Cry, m exeoution of" easement
will occur upon its acceptance. However, this authorization will allow the property to be sold to a new
homeowner.

This was discussed at the Transportation & Infrastructure Committee at Its most recent meeting. At that
time, the City Engineer recommended that in addition to authorizing this easement in orderto allowthe sale
of the home to move forward, the potential for revising the subdivision to eliminate the setback violation
should also be explored. At this point, no other homes have been constructed in the Immediate vicinity, of
this properly, and the potential exlststo realign the right of way of Cardinal Way W allow the home that has
been constructed to meet the set bark. The Committee was supportive of this approach. In order to allow
the sale to proceed, the Committee recommends your approval. Subsequently, staff will investigate the
potential for a revision to the subdivision plan.

Setback Error — Lot 17, Sussex Pines Subdivision.
BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR THAT:
Edward A. Barrett, City Manager, Is hereby authorized and directed to execute an
easement to cure a setback error from Cardinal Way for Bangor Housing Development
Corporation at Sussex Pines Subdivision, lot 17, if cure is necessary at the time the
street is accepted by the City, in a form W be approved by the City Solicitor or Assistant
City Solicitor.
