Date: April 10, 2006 06 144 Item/Subject Ordinance, Amending Chapter 265, Solid Waste, By Adding New Subsection 265-3(3), and Amending Chapter 211, Property Maintenance Code, By Adding New Section 223-4, Esplanades, to Require Property Owners and Occupants to Maintain Adjacent Esplanades Responsible Begun Is tint Code Enforcement Commentery: These two amendments will require owners and occupants to maintain the esplanade adjacent to the property. "Maintenance" includes, but Is not limited m, cutting the grass and keeping the area free and dear of trash, debris, and discarded items. Ban esplanade is not mairHalned after within five days of wntten noticefrom the Code Enforcement Officer, the City may remedy the condition and bill the owner and occupant for true maintenance costs. Department Head This amendment is proposed in an effort to address the continuing problem we are experiencing with improper material being placed at the curb for collection. When this material is not collected, It often remains in the esplanade for a considerable period of time during which Code Enforcement attempts to find the owner/occupant and have the problem addressed. if voluntary compliance does not result, we normally begin court proceedings which on take many months during which the materials may remain on the street Under this proposal, the owner/occupant would be given five days to remove the unacceptable material. If not removed, we would then remove with City forces and bill for our costs. It is our hope that this will shorten the length of time such materials remain at the curb. ea arwnMW: n.p,9ra,rt.4fti .t.rE. -nY ric.
