Commentary:
PUBLIC HEARING REQUIRED.
Norumbega Venture Capital, LLC purchased the property at 53 Charles Street In 2003 and, In
late 2009, obtained a Building Permit W gut and rehabilitate the property. Work ceased after
the building was reduced to a shell. There is no evidence of any sobsltrndal work being
performed in the last year. The building has been left gutted and unsecured and has become a
blight and a public nuisance.
Attached m this Order you will find a variety of documentation regarding the condition of the
structure, the debris which has been stored on the lot, and the steps When by the City to
attempt bring the property into compliance with our Codes.
A public hearing must be held prior to taking action on this order. The City's Cade Enforcement
Officer, Dan Wellington, will provide testimony on Me condition of the building and the
property. Based on this testimony, as well as that of other partes who may appear, we believe
that Me record will supply ample support for a Council finding that it constitutes a dangerous
building as defined by Titre 17 of the Maine Revised Statutes.

The City has worked for some time in an effort to address the status and condition of this
Property. To date, these efforts have not been successful. Given the condition of this building
and the property as a whole, we recommend that Mis order be approved ab nt th assurance

WHEREAS, the City d Bangor has received numerous complaints about the physical condition and safety

WHEREAS, the Code Enforcement Office has inspected the Promises and determined that the Premises
suffers from numerous code vioatons; and
WHEREM, the Promises is ewnd by Norumbega Venture Capital, LLC of Saarsmond, Maine (hereinafter
the-Owrerl; and
WHEREAS, the Owner and Martgagar, have been notified that the Bangor City Council Intended to hop
a pubic hearing an consider whether or not the Premises mmtitu[es a dangemus building and a nuisance
under 17 MAZA. §§ 2851-2859; and
WHEREAS, the Bingo City Coundl, acting In Its capadty as the Municipal Officers of the Qty of Bangor,
held a Runde hearing pursuant 12 M.R.S.A. §§ 2851-2859 to determine whether or not the Premises
mnstiWtes a dangerous building within the meaning of said nature; and

NOW, TIEREFORE, the City Council of the City a Sargar hereby ORDERS:
1. The Owner, i.e., Norumbega Venture Capital, LLC, shall, within Midy (30) days, secure Me

applicable Wilding, Musing, and property maintenance code standards adopted

located a 53 Charles Street is a dangerous building and a nuisance under Title
17, Chapter 91, Subchapter N.
Me property is ownetl by Norumbega Venture Capital, LLC; the comorations
only, shareholder, William Walton, is expected to attend the hearing 'the City
has also notified the two mortgagees of the hearin& in accordance with 17
M.R.SA.§2551(1). Hoxver, the mortgagees'attendmoccris not anticipated an
both are from out-of-state and both are relatives of Mr. Walton.
During the hearing, the Code F,nforcemeat Officer will ofin evidence regarding
the condition of the buildiv& The owner and members of the public may, also

Since this is an adiudicatmy proceeding. Due Process requires that the Council
base its deasism on the evidence submitted is it on the record, such as
documents submitted m advarme of the meeting and documents and testimony
submitted during the public hearing. If necessary, the Council may keep the
retard open for a limited period of time after the hearing for documents that
may be requested by the Coundt but that are nm available at rhe hearin&

order should:

At your request, I looked at these two properties for the purpose of providing areport concerning fire issues.
Both Properties appear abandoned and both are in an advanced state of strucNrd deterioration- The foundation
1 of the Larkin StreetProperty has caved in, which efforts a point of entry into the buildin& Animal hacks are
evident going into and out of the building in the fresh snow today.I talked to the neighboring property owner,
Ron Buckley, m 0 Larkin Street. He relates that unauthorized entry, into the building has been an on-going
problem.
The property m 53 Charles is not secureA and the grounds are littered with trash and junk. Birds are occupying
the building. Our personnel working around the structure would encounter additional risks due to the were of
the grounds.
Om concern from a fire prevention perspective with these properties is urreuthorized entry leading to a fire
either amidentally, or as vandalism. The Larkin Street property is very close to neighboring shadow; and
would pose numerous challenges for our fire personnel in the event of fire the is act immediately discovered.
Also, this building is set far back on its lot in comparison to neighboring structures, which would and to hinder
handfuls discovery of a fire.
NFPA reports, "Every year, the m jmity of intentionally set structure fires occur in homes, which is perhaps
not surprising, when half or more of min anestcea are predates. Of the Mmes suffering intentioned fires in
the latest statistics, one -forth to one-third were vacant, idle, under construction, or being educated or

It has come to the attention of the Cade Entorcerrlent Office that
renovations are being conducted at 53 Charles Street without benefit of a
building permit. A building permit must be secured from the Code Enforcement
Office within 5 days of recedpt of this notice. Any plumbing or electrical work also
need permits and must be secured by a licensed, master plumber and a licensed
master electrician.

On or about August 30, 2003, gid above captioned property was found to
be unfit for human habitation based on the finding of unsafe conditions and
.vandalism by the City of Bangor. You were advised of the City's findings and.
placarding of the structure as unfit for human habitation under separate notice.
The purpose of this letter is to advise you of your responsibilities under
Chapter 223, Section 223.3 relating to securing, and rehabilitation of the
structure, the time fames allocated by the ordinance to complete the work and
. the penalties for failure to comply.
Please review this information carefulty. Questions should be directed to
this office. Your right to appeal this order are the same as your right to appeal the
findings that the structure is unfit for human habitation. Again, please note there
are substantial monetary penalties for failure to comply. Finally, permits may be
required for certain repairs and some type of work is restricted to licensed
tradesmen under State law. Well be happy to answer any questions that might
arise

§223-3. Uninhabitable Buildings
A. BUILDING TO DE SECURED. After any building or someone or portion thereof bas been
vacated and placarded by order of the Code Enforcement Officer as until for human habitation pumuant
m the Code of the City of Bangor, or is vacant and is in such condition that no residential, commercial or
other authorized not could be made of same, the Code Enforcement Officer shall require that any such

project site regularly and have not seen anyone on site or noted any change
