Exempting Me Downtown Parking Management Area from the Wintertime
Overnight Parking Ban under Certain Conditions

The 2005 Downtown Parking Advisory Committee recommends that the ordinance relating to overnight
parking on public streets be reviscb to allow year-round parking on downtown streets except when the
Division of Public Works issues a snow-deabng order. Currently, parking on any public way is prohibited,
dty-wide, between Nov 1 and Apr 1, except for specified areas. Downtown resident: and downtown
residential landlords have been escalating their requests for a change in this policy. Public Works and
Parking Enforcement personnel anticipate that this change will dramatically increase the number a
vehides towed during and after a snowstorm. The committee believes this Mange also aligns parking
policy with the City's encouragement of downtown lying spaces.

The Transportation and Infrastructure Committee has reviewed this recommendation. The Committee
voted not to support it on a 2-1 vote based on concerns regarding impacts on snow plowing and removal
downtown and the potential number of vehides that might require towing.

(TALE.) Ordinance, Amending Chapter 291, Sections 43 and 44 of the Code of the City of Bangor

BE IT ORDAINED BY THE CITY COUNCIL OP T HE CITY OF BANGOR MAT
Chapter 291, Sections 43 and M of the Code of the City of Bangor are hereby amended and replaced
In their entirety as follows:
§ 29143. On -street and off-street parking areas.
A. Wmtertlme paddng• kept for any public way, as defined in D -A M.R.S.A. § 505, public
square, or on -street public parking area in the Downtown Parking Management Area as
established by § 291-37(13), it shall he unlawful and in violation of this aride, between
Now:mber 1 and March 31 of each calendar year, for any person:
(1) Nighttime parking prohibited: to stop, stand or park, or allow to remain, a vehicle In or --
upon any public way, as defined In 17-A M.R.S.A. §505, public square or on -street or
off-street public parking area within the City of Bangor between the Mum of 12:00
midnight and 6:00 a.m., Eastern standard time or Eastern daylight time, as may Man be
in effect.
(2) Daytime alternate -side parking:
(a) To stop, stand, remain in or upon any public way, as defined in 17-A MRSA.
§ 505, within the City of Bangor between the hours of 6:0D a.m. and 12:00
midnight. Eastern standand time or Eastem daylight time, as may Men be in
effect, except that parking shall be permitted on the odd -numbered side of such
public way an the odd -numbered days of the month and parking shall be
permitted on the even -numbered side of each public way an the every -numbered
days of the month.
(b) Exceptions. The parking restriction above shall not apply W:
[1] Metered speeds and ways;
[2] Pardons of public ways where parking is otherwise prohibited;
[3] State Street between its intersection min pine Street and Summit
Avenue, as posted; and
[4] Cedar Street between Its intersection with Main Street and First Street, as
posted.

A-1. Within any public way, as defined in 17-A M.R.S.A. § 505, pudic square or on -street parking
area in the Downtown Parking Management Area as established by § 291-37(B), R shall be
unlawful and In violation of this article for any person to stop, stand or park, or allow to remain,
a vehicle in or upon said Public way, public square or on -street public parking areas during a
Snow Clearing Order.
(a) The Division of Public Wools shall issue a Snow Clearing Order whenever the
Director of Public Works, In his or her sole discretion, deta-mirws that such Order
is appropriate for safe and orderly plowing and subsequent removal of snow and
Ice.
(b) The Snow Oeadng Order shall be Issued with as much advance node to the
pudic as practicable under the circumstances and shall remain in effect until
cancelled by the Director of Public Warks.
(c) This section dors not apply to any off -sheet public parking areas. Such off-
street public parking areas remain subject W subsection (A) above.
B. Sow removal. Notwithstanding the provisions M Subseddora A and A-1 above, no person shall
step, stand or park, or allow to remain, a vehicle in or upon any public way, as defined in 174
M.ILS.A. §SDS, public square or onstreet or off-street public parking area within the City of
Bangor during any hour of Me day so as W interfere with or hinder Me removal of snow by the
Ory horn such way, square or paddng area. Any vehicle found to be parked in violation of this
subsection may be removed and placed in a suitable parking place in accordance with the
procedures described in 29-A M.R.S.A. § 2089.

E. Continuous parking prohibited. Notwithstanding Me provisions of Subsections A and A-1 above,

continuous Period exceeding 24 hours.
§ 29144. Removal of unauthorized vehicle.
Any vehicle found in violation of §§ 291-38, 29142 and 29143 of this article may be removed and
impounded in accordance with Me procedures established under § 29146, Subsections C and D of this
article. M addition, any vehicle found in violation of § 29143A(1) of this article may be similarly
removed and impounded should the violation occur during or within six hours of the and of a snowfall
in excess 4one inch or tludng Me periods in which the City is actively involved in mrowplowing or
snow removal operations.
