O rdi R call C e r Amending Land Development Code — Contract Zone Change - Adjacent to 631 Hammond Street from Urban Residence -One District to Contract Neighborhood Service District. � a aCrNe06Y the Ory ofBargor, as/aWnr THAT the zoning boundary lines as established by the Zoning Map of the City of Bangor dated October 28, 1991, as amended, be hereby further amended as follows: By changing part of a parcel of land located adjacent to 631 Hammond Street (Tax Map 6, portion of Parcel No.113) from Urban Residence -One District to Contract Neighborhood Service District. Said parcel containing approximately 3,300 sq. R. and being more particularly indicated on the map attached heretoandmade a part hereof. PROVIDED, HOWEVER, THAT iR addition to the mandatory conditions Imposed by Chapter 165-7 of the Ordinances of U City of. Bangor, mid change of zone is granted subject to the following conditions: _ 1. The use and/or operation of the subject premises shall be subject to the following limitations and/or restrictions: A. The overall development of the subject property shall be subject to a maximum impervious surface ratio ("ISR') of 0.5. B. Building Floor area shall be limited to a maximum of 365 square feet C. Property shall be developed with a minimum C4 Buffer adjacent to any Residential districts. 2. Execution by those parties with an interest in the affected property of an agreement providing for the implementation and enforcement of all the terms and conditions set forth above and the recording of said executed agreement in the Penobscot County Registry of Deeds by the property owner, a copy of said agreement being on file in the office of the City Clerk and incorporated herein by reference. In the event that said agreement is not so executed within ninety (90) days from the date of passage hereof, this Ordinance shall become null and void. Gould, Planning Officer SUBJECT: Amending Zoning Ordinance Adjacent to 631 Hammond Street Council Ordinance 06-089 Please be advised that the Planning Board at its regularly scheduled meeting on March 7, 2006, held a public hearing on the above contract zone change request. Ronald St. Pierre, Vice President of Fitch & Company and representative of the applicant, Indicated that they were seeking to acquire the existing building at 631 Hammond Street for office space and wanted some additional area to expand. The adjacent property owned by Mr. Garfield Foss and presently used as an automobile impound yard Is zoned Urban Residence 1 District. The proposed contract zoning agreement would allow a small expansion of the building and allow for a bufferyard along the remaining residential district. Mr. Dan Tremble, owner of 631 Hammond Street indicated that he operates a business on Hammond Street and was familiar with this propertys history. Mr. Tremble indicated he purchased the property several years ago and believes this would be a good use for the property and neighborhood. Mr. Garfield Foss, present owner of the adjacent impound lot, indicated that he was in support of the proposed rezoning. No one spoke In opposition to the proposed rezoning request. After careful consideration of the existing uses in the area, the proposed land use in the Comprehensive Plan, and the historic use of the land to be rezoned, the Board voted unanimously to recommend the proposed contract zone change request.
