The purpose of this amendment is to clarity that parking structures must meet the applicable zoning
district's setback requirement for structures rather than parking lots. This recognizes that such garages
are structures, not surface lots, and should be treated in the same manner as other buildings located
within the zone.

Structures, to Clarify Setbacks Applicable to Parking Structures.

That Chapter 165, Land Development Code, 4 165-75, be amended by adding the underlined text, as
follows:
165 75. Parking structures or decks. -
Parking structures or decks shall meet the design standards of 4 165-74A(1), (2) and (3) above,
except that the Planning tIDarci may alter such standards In cases where the designer on
demonstrate a reasonable need for such alteration because of the particular structural arrangement
of the proposed structure or deck and can demonstrate the workability of the parking and
circulation arrangement within the structure or deck. Parking schictures or conics sinall meet one
applicable s-boictum setback for ft district

Amending Land Development Code
Chapter 165-75 Parking Structures
Council Ordinance 06 - 22
Please be advised that the Planning Board at its regularly scheduled
meeting on December 6, 2005 held a public hearing on the above land
Development Code Amendment.
The Planning Staff indicated the proposed language was developed to
make it dear that parking structures should meet structure setbacks and not
(surf") parking setbacks. In addition, required buffer yards for surface parking
would not apply to parking structures.
It was noted that further review concerning architecturel guidelines and
/or alternate landscaping approaches were being investigated but given the
City's limited experience with garages more time to explore those mitigation
measures would be required.
The Board discussed the applicable setback requirements for parking in
various districts and concurred that the proposed clarification is warranted.
The Board vote unanimously to recommend the City Council adopt the
proposed land Development Code Amendment.
