Order, Authorizing the City Manager to Execute a Commitment Letter to the Maine Department of Transportation — SBllvater Avenue and Hogan Road Traffic Improvements BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR THAT WHEREAS, Wal-Mart Real Estate Business Trust (Wal-Mart) has an approved site plan to develop a Wal-Mart Supercenter an Stillwater Avenue; and WHEREAS, Said development will be an investment by Wal- Mart in excess of $20 million; and WHEREAS, as part of Wal -Mart's development It shall be required to spend in excess of $3.6 million for off-site traffic related improvements; and WHEREAS, the Traffic Movement Permit (TMP) Issued by the Maine Department of Transportation (MEDT) for the development required additional off-site traffic related Improvements t1 the Bangor Mall area, Including improvements to Hogan Road, Springer Drive and Bangor Mall Boulevard at a substantial cost; and WHREAS, the off-site traffic Improvements benefit the City of Bangor and are Improvements that eventually would be necessary because of the increasing traffic in the Bangor Mall area. NOW, THEREFORE, BE IT HEREBY ORDERED THAT the City Manager B hereby authorized, on behalf of the City of Bangor, to execute a Commitment Letter to the Maine Department of Transportation substantially in the form as attached hereto and in a final form as approved by the City Solicitor or AsslstaM City Solicitor, provided that Wal-Mart Real Estate Banuess Trust legally obligates itself to the City In a form satisfactory to the City Solicitor or Assistant City Solicitor to pay to the City the sum of $250,000 for construction costs for the Hogan Road Extension.. The City will pay for and do, or contract to have done, the following: Hogan Road Extension The City will have construction of the Hogan Road Extension completed by May 15, 2008 or by the time that the Wal -Man project is issued its conificme of occupancy, whichever is later. Construct Hogan Road extension m connect to the development. This shall be minimum two lane road with lane widths as determined by the City of Bangor. There shall be two receiving lanes for a length of 400 feet and an appropriate taper. Hogan Road extension shall also have a 250 foot long left tum lane, a full length through lane and a 250 foot long through right One. Off -Site Mitigation (Hogan Road) The improvements listed below shell be completed no later than October 15, 2008. Hogan Rnad/Loneview Drive Stripe Longview Drive to provide a left -Nm lane with 150 -foot storage turning onto Hogan Road. Modify the traffic signals at the intersection of Hogan Road and Longview Drive to accommodate the new cross section and lane changes as described above. He= Roed/Baneor Mall Blvd /Sorineer Drive: Widen the Bangor Mall Blvd. approach to Hogan Road to provide: one 150 foot left torn storage has; one -fall length left turn Lane; two -full length through travel Issues, and one -full length right tum lane. All lanes to be minimum 11 fest. Widen Springer Drive east bound to provide two -250 feet, plus tapers Imesm receive traffic from Bangor Mall Blvd. All lanesto beminimum 11 feet Widen Wedbound to accommodate two left tum lanes, a through Issue and a throigt✓right lane. Widen Hogan Road south bound, as needed, to accommodate a 500 foot long left tum Issue, 3 though lanes and a 500 hurt long right tun lane, from apoint approximately 500 feet nosh of Bangor Mall Blvd, to the intmation on Hogan Road mrd Bangor Mall Blvd. This is primarily to be accomplished by removing the existing cbasunelization island and re -striping the existing pavement, but may require scone minor shoulder widening. All lanes to be minimum I l fest. Other Mitieation The following mitigation home in this section shall be designed immediately and constructed as needed. Need will be determined by the MaineDOT in consultation with the City of Bangor. Stillwater Avenue and North Mall Drive: Construct 1-200 foot, plus tapers, right tum Issue on north bound Stillwater Avenue for traffic entering the North Mall Drive. All lanes to be minimum 11 Rat Stillwater Avenue and Circuit City Drive: Construct 1-200 foot, plus tapers, right dun lane on south bound Stillwater Avenue for traffic entering the Ctimuit City Drive. All lanes to be minimum 11 feet. Stillwater Avenue end Baneor Parked¢ Drive: Extend the present south bound right two lane in the Stillwater Avenue/Sooth Mal Drive intersection and murk as a thsrouglihight lane. Construct a second south bound travel lane on Stillwater Avenue south of the intersection as a receiving lune. This lane adult be 500 feet long plus tapers. All lanes to be mhdmum 11 feet. He= Road and Lonuview Drive: Widen the north boom approach on Hogan to provide 1-200 foot long right tum lane from Hogan Road onto Longview Drive. All lanes to be minimum 11 feet. Reshipe the Longview Drive approach to provide 1 -exit lane, 2 -left mm lanes and 1 combination throughlright. All lanes to be minimum 11 feet. Hoean Road and Stillwater Avenue: Widen Hogue Road to provide 1-150 foot long right tum lane Gam Hogan Road onto Stillwater Avenue north bound. Ali lanes to be minimum 11 feet. Sincerely, Edward A.
