The PenjaJawoc Marsh -Bangor Mall Management Commission has reviewed the City's Compnehemive Plan in
regardtothe propertyat 121 Gilman Road. This property was originally one part of a larger parcel including
the adjacemproperty at 107 Gllman and a third mmiguous parcel. The three parcelswere created when the
Property was split among the helm of the original owner. Two of the threeparcels In question are currently
designated as appropriate for commercial uses, where 121 Gilman is not. This appears to create an
inequitable situation among the family members and heirs the owner of the original property. The history
of this parcel was not known m the Mall/Marsh Task Force at the pme It develped its land use
recommendations that were subsequently adopted as a part of the aWs comprehensive plan. The
Management Commission has reviewed the status of this parcel and has recommended that the original
oversight be addressed by designating 121 Gilman as appropriate for commercial development.

(TITLE.) Order, Directing the Planning Board to review the CWs Comprehensive Plan,
Land Use and Zoning Policy on Gilman Road
WHEREAS, the City Council of the City of Bangor adopted the Comprehensive Plan
2005 Update on Jury 10, 2006 by Council Order 06-264 ; and
WHEREAS, the Co nprehensive Man calls for applying a rural land use policy to 121
Glman Road (R554) as designated on Exhibit A, attached; and
WHEREAS, the adjacent property at 107 Gilman Road (RSS-4A) is indicated as a
commercial property; and
WHEREAS, the properties at 107 and 121 Gilman, along with a third adjacent lot, were
once in single ownership; and
WHEREAS, this larger, family-owned parcel was wbsequently divided among the heirs
of the previous owner, all of whom are related family members; and
WHEREAS, the history of this pmperty and its wbdivision into three lots was not
known by the Marsh/ Mall Task Force at the time it developed and
presented Its land use recommendations; and
WHEREAS, the majority of the Penjajawoc Marsh -Bangor Mall Management
Commission sees this as a oversight in the original Task Force report's
depiction of appropriate land use boundaries; and
WHEREAS, given these circumstances, it is appropriate to conduct a review of the
City's Comprehensive Plan and supporting Land Use and Zoning Policy in
mid area to address this oversight;
NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF
BANGOR THAT the Planning Board 1s directed to hold a public hearing and review the
City's Comprehensive Plan (and Use and Zoning Policy on Glman Road as designated
on Exhibit A, attached, and, if deemed appropriate, present to the City Council proposed
amendments to the City of Bangor Comprehensive Plan 2005 Update dated July 10,
2006.
