IN CITY COUNCIL �Peebbru,fry�26, 2200007 CITY ,t93K TY claxx q 07-095 OMEN (TITLEa Authexining a ecutian of a Cooperative Agreement with MET - Improvements and Constroction of US Acute lA and Harte 9 at Main Street, Saome[ Street, and Ced St[ e[ AWgned to CYaovW rby-ggqtp/n� v I •✓ Cooperative Agreement 07 055 Between the CITY OF BANGOR And MAINE DEPARTMENT OF TRANSPORTATION REGARDING IMPROVEMENTS AND CONSTRUCTION OF US ROUTE 1A AND STATE ROUTE 9 I BANGOR,ME Whereas Me City of Bangor (Bangor) has approached the Maine Department of Transportation (MaineDOT) to utilize High Priority Project (HPP) funding included in the Safe, Accountable, Flexible, Efficient, Transportation Act: A Legacy for Users (SAFETEA-LU) to fund the scope of work included in attachment A and B, Whereas this project supports safety, mobility and local economic development initiatives, Whereas HPP funding Is subject to Obligation Authority limitations decided annually In Congress, Whereas HPP federal funding requires a minimum non-federal 20% match, Whereas Bangor has an established practice of locally administering capital transportation projects containing federal funding. NOW THEREFORE, Me City of Bangor and MaineDOT, agree to Me following: 1. Bangor and MalneDOT agree on the scope for Me project as outlined in Attachment A. 2. Bangor understands Congressional Appropriations process requirements associated with HPP's and agrees on a "current" estimated available funding for this project In the amount of $1,593,520 ($1.275 million federal, $318,750 non-federal). Estimated available funding for this project will be revised annually based on the Congressional Appropriations process. 3. Bangor and MameDOT agree to split the required non-federal 20% HPP match 50/50, currently estimated at $318,250 (estimated, $159,325 City, $159,375 State). 4. Bangor understands and agrees that any costs In excess of the HPP available funding and the minimum non-federal match will be the responsibility of Bangor and the Bangor Area Metropolitan Planning Organization. For example, If $1.6 million ultimately becomes available from Me HER B match but pmJect costs $2 million, Bangor or BACTS would fund the additional $400,000 for this project. 5. Bangor will attend appropriate project team meetings and proactively participate in all public involvement activities associated with this project including introducing this project at public meetings, discussing the Bangers continued support for this project and collaborate in development of and explaining work window restrictions. This participation will represent in-kind staff contributions not included in Me above amount for MIs project. Pagel V302007 07 055 6. Bangor understands and agrees that a fully executed Local Project Agreement will be required prior to commencement of this project. y. By agreeing to Locally Administer this project, Bangor assumes the risk to ensure that all regulatory federally processes are followed and Bangor will assume full responsibility for all costs deemed non -participating by the Federal Highway Administration (FHWA). Bangor Is also responsible for coordinating with MaineDOT's assigned project manager regarding schedule, costs and key project decision points. MaineDOT may postpone, suspend, abandon or otherwise terminate this Agreement upon thirty (30) days written notice to the City of Bangor and in no event shall any such action be deemed a breach of contract. postponement, suspension, abandonment or termination may be taken for any reason by MaineDOT or specifically as the result of any failure by the City of Bangor to perform any of the services required under this Agreement to the satisfaction of MaineDOT. The City of Bangor and MaineDOT agree to function within all applicable laws, statutes, regulations, and Cooperative Agreement provisions; avoid hindering each other's performance; fulfill all obligations diligently; and cooperate in achievement of the intent of this Cooperative Agreement. Cole, Commissioner Maine DOT Date Pege 3 1I 00007 07 055 Due to the difficult series of maneuvers from northbound Main Street to Railroad Street to Summer Street and the reverse maneuvers from Summer Street to southbound Main Street, It is recommended to: • Discontinue Summer Street as a public way between South Street and Railroad Street; • Relocate Summer Street to Main Street at the intersection with Cedar Street; • Provide double left tum lanes and a combined through and right turn lane on Summer Street approach to Main Street; • Provide aright turn lane on the northbound Main Street approach; • Relocate South Street approach to relocated Summer Street; Provide a separate left and right turn lanes on South Street approach to Summer Street; and Relocate and update the traffic signal equipment at the Main Street„ Summer Street and Cedar Street Intersection.
