THAT WHEREAS, Dutton Street from Main Street extending northeasterly to Bass Park was accepted as a public way November 6, 1683, and; WHEREAS, said portion of Dutton Street beginning approximately 160 feet northweste ly of Main Street and extending to Bass Park is no longer necessary to serve the public needs; NOW THEREFORE BE IT ORDERED, that the City Engineer be and hereby Is directed to begin the process of discontinuing said Pardon of Dutton Street in accordance with 23 M.R.S.A. §3026 and submit a written report be the City Council for further action. This action is being pursued in order to accommodate the Racino Gaming facility that Penn National plans to develop. Notice is hereby given Utat in pursuance of City Council Order No. 06-363 passed October 23, 2006 directing the City Engineer th discontinue a portion of Dutton Street as outlined above and in accordance with 23 M.R.SA §3026, the City Engineer will hold a public hearing on November 7, 2006 at 10:00 a.m. EDT in the Engineering Conference Room, City Hall, 73 Harlow Street, Bangor, Maine to consider discontinuance of said street and determine the damages or benefits, if any, sustained by any party as a result of this action, apportion same, if any, according to law, upon the labs or parcels of land damaged or benefited by such discontinuance.
