Lawler for Building #26, 113 Maine Avenue Responsible belle to nal Community & Economic Development Commentary: The Council previously designated David tawler as Me tentative developer of the building at 113 Maine Ave. Staff has negotiated a purchase option and development agreement for this building, Including .83 acres of surrounding land, for a purchase price of $100,000. The option will run until November 30, 2008 and must be exercised no later than October 31. There is a non- refundable option fee of $1,500 which will be applied to Me purchase price. The developer will be allowed M request one (1) vehicular entrance/egress to the site from Maine Avenue, subject to land development permit approval by the Planning Board. Zoning, subject to the recommendation of the City of Bangor Planning Board and approval of Me Clry Council, will be changed from Government and Institutional Services District to a contract Industry and Services District that will allow as permitted uses: radio and television facilities; information processing and communications facilities; research and testing facilities of a laboratory nature; administrative offices of manufacturing, retail, banes% public utility, service or research corporations; service business limited M office use; retail sales which are Incidental to any permitted use; group day-care or nursery school; day-care anter; clinic, medical or dental; and pudic ut14 and public service uses. No Conditional uses will be allowed. The developer will invest a minimum of $300,000 in this project, inducing the $100,000 acquisition cost, and shall provice Qty staff with proof of financial apabilfty and a binding contract for the Improvements. The Business and Economic Development Committee will approve the plans for the building renovations and site improvements, Inducing paMng and vehicular acoess prior to conveyance of the property. Developer will obtain all necessary permits, Including site plan approval from the Planning Boats, prior to conveyance of the property. Site work and building Improvements will begin by December 1, 2008 and be completed by Novwnber 30, 2009. ORDER, Authorizing Purchase Option and Development Agreement with David B. Lawler for Building #26, 113 Maine Avenue WHEREAS, David B. Lawler has submitted a proposal to the City to rehabilitate Building #26 at 113 Maine Avenue into a modern, attredive office building for business use; and WHEREAS, the City Council initially designated David B. Lawler Tentative Developer of Building #26 at 113 Maine Avenue by passage of Council Order 08-199 on May 28,2008 to allow time to prepare a definitive development proposal and for City staff to negotiate a proposed Development Agreement for consideration by the City Council; and WHEREAS, City staff has negotiated a Purchase Option and Development Agreement with David B. Lawler; and WHEREAS, the Purchase Option and Development Agreement establishes the terms and conditions under which the development would be allowed to move forward, ensures that the development would conform to building plans, site plans, and uses approved by the Business and Economic Development Committee, and requires that David B. Lawler demonsdate the financial capacity and ability to cant' out the development as approved; NOW, THEREFORE, BE IF ORDERED BY THE CRY COUNCIL OF THE CITY OF BANGOR THAT The City Manager Is hereby authorized to execute, on behalf of the City of Bangor, a Purchase Option and Development Agreement with David B. Lawler providing for the purchase and development of Building #26, 113 Maine Avenue, under terms and conditions substantially as contained in the Purchase Option and Development Agreement between the City and David B. Lawler, a copy of which is on file in the office of the City Clerk, and In a final form approved by the City Solicitor or Assistant City Solicitor.
