Commentary:
This amendment is a correction to the Definition of Open Space Parcel adopted at the Council's August 11,
2008 Meeting. With numemus drafts in circulation, an obsolete version was inadvertently provided in the
council Agenda. The amended definition maloa; It clear that a parcel can be deemed an open space parcel
whether in an approved subdivision or nv L

Amending land Development Code
Chapter 165-13,
Council Ordinance 08-286
Please be advised that the Planning Board at Its regularly scheduled
meeting on September 2, 2008 held a Public Hearing on the above Land
Development Code Amendment.
Planning Officer Gould indicated that the proposed language was
developed to correct the language recently adopted. Mr. Gould noted the
language was written so as to apply to open spaces when part of a subdivision
and when an open space may be designated outside of a subdivision.
Member Damon asked If the provision could lead to the potential that
open space would be required of developers.
Mr. Gould noted that the Subdivision Ordinance already requires open
space for new development (subdivision). The language dadfles that "open
space" is exempt from certain development standards that would typically be
applied to development parcels such as mad frontage, minimum lot area, and
minimum lot width.
There were no public comments In favor of or opposed to the proposed
amendment.
The Board voted seven in favor and none opposed to recommend the
Ordinance Amendment (08-286).
