Wastewater Treatment Rates — Surcharge Fees

Our current sewer ordinance auNorizes discretionary surcharges for sewer users that discharge
high strength waste into our sewer system. Over the last year, the Transportation and
Infrastructure Committee has held a series of discussions regarding imposing such surcharges
on our limited number of high strength accounts. As a result of chis discussion, surcharges were
implemented.
Recently, the Committee reviewed an agreement with a user regarding the payment of the billed
surcharge. During that discussion, the Cammittee suggested that our ordinance be amended to
make such charges mandatary in order to make it clear that users who cause additional expense
for our treatment system will be charged for Nose additional costs. The attached amendment
will accomplish Nis.

CITY OF BANGOR
(TITLE.) Ordinance, Amending Sections 252-24 D and E of the Code of Ordinances —
Wastewater Treatment Rates — Surcharge Fees
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR THAT
Section 252-24 of the Code of Ordinances is hereby amended as follows:
D. Surcharge fees.
(1) In addition to any penalties and fines required by this chapter and state or federal law,
as well as regular sewer use charges, the City atay shall impose surcharge fees on any
user that discharges into the POTW and the discharge causes or constitutes the
following:
(a) Slug or slug load;
(b) Interference;
(c) Pass-through;
(d) Excessive loadings, including excessive loading caused by high-strength
corwemional waste from a nonpermiHed user;
(e) Violations of § 252-9 of this chapter; or
(f) Any other discharge Which adversely affects the POTW or increases the City's
cost of treating wastewater In the City's POND.
(2) Surcharges shall not exceed 50% of the normal sewer user charges, unless said
amount is necessary to offset the Ciry's cost of treating the discharged material,
Including any costs Incurred by the City for violations of the CiWs MEPD i NPBES
perk.
E. All surcharge fees and pretreatment charges and fees shall be set from time to time by She
Superintends GittGeenaFerAer and shall be kept on file for public inspection at with the
Qfflcg of the City Clerk and the Wastewater Treatment Plant Snperiahwdem.
