Item/Subject: ORDER, Authorizing the City Manager to Execute an Agreement with
Bangor Histonc Track, Inc. for Land for Parking Lot — Dutton Street.

Commentary:
In 2006, the City and Bangor Historic Tack, Inc. (BHF) entered into a Development
Agreement and Lease. The leased area Includes part of the City's land behind the Irving
station located at Main and Dutton. BHrs intent was to build a parking lot to be used for
overflow and employee parking. The parking lot has been constructed. BHT has now
decided that they would like to lease the remainder of that lot to create additional parking.
This Order will authorize the execution of documents necessary to allow BHF to use the
additional land for parking. R will Include a provision that, upon reasonable notice, the
City can terminate the agreement if the land becomes necessary to the City for the new
arena/large meeting facility. The documents would also provide that In the event
termination Is necessary, the City would cooperate with BHT to find an alternative location
for BHF's parking needs and that BHT will pay rem based upon the same formula as in the
current lease with BHF.

CITY OF BANGOR
(TITLE.) ORDER, Authorizing the City Manager to Execute an Agreement with
Bangor Historic Track, Inc. for Land for Parking Lot— Dutton Street.
WHEREAS, in 2006, the City of Bangor and Bangor Historic Track, Inc. (BHT) entered
into a Development Agreement and Lease Including a portion of land along
Dutton Street for overfiow and employee parking; and
WHEREAS, BHT has requested additional land along Dutton Street consisting of
approximately 1.69 acres to build additional overflow and employee parking.
NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CIN OF BANGOR
THAT
The City Manger is hereby authorized, on behalf of the City of Bangor, to execute
necessary documents with Bangor Historic Track, Inc. permitting Bangor Historic Track,
Inc, to use additional land along Dutton Street consisting of approximately 1.69 acres
for overflow and employee parking. Said documents shall include provisions that, upon
reasonable notice, the City can terminate the agreement if the land becomes necessary
to the City for the new arena/large meeting facility; that, in the event termination is
necessary, the City will cooperate with Bangor Historic Track, Inc. to find an attemative
location for its parklrg needs; and that Bangor Historic Track, Inc. will pay rem based
upon the same formula as in the current lease between the City and Bangor Historic
Track, Inc. Said documents shall be In a final form as approved by the City Solicitor or
Assistant City Solicitor.
