The moratorium was retroactive to July 17, 2007 and effective through November 1, 2007. There have been several discussions at Council Committees an proposed changes to the Cltys Land Development Cade to address the Issues which gave rise to the need for a moratorium. As a result, a number of Ordinance amendments have been referred to the Planning Board, including a proposal to rezone a number of parcels in the Summer/Main Street area to Waterfront Development District. At its last meeting, the Planning Board tabled consideration of one proposed ordinance change. In addition, public notice requirements for the proposed restoring will result in the proposed ramping not being acted upon until after the November I expiation of the moratorium. As a result, not all of the ordinance changes that have been proposed will come before the Council for final action before the expiration of the moratorium. State law provides that a moratorium can be extended If the need for the moratorium continues to exist and the municipality has made reasonable progress to alleviate the problems. This Ordinance will extend the moratorium until December 1, 2007. Ordinance, Extending a Moratorium on Development in the Waterfront Area BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR THAT WHEREAS, the City enacted a moratorium on development in the waterfront area on August 13, 2007 by Council Ordinance 07-249; and WHEREAS, the moratorium is no longer in effect on November 1, 2007; and WHEREAS, the City Council and City staff have made reasonable Progress to alleviate the reasons that gave rise to the need for a moratorium; and WHEREAS, mere Is currently pending before the Planning Board certain proposed charges to the CiWs Land Development Code; and WHEREAS, the proposed changes will not be before the City Council before the expiration of the moratorium. NOW, THEREFORE, BE IT ORDAINED BY THE QTY COUNCIL OF THE CRY OF BANGOR THAT, pursuant to 30-A M.R.S.A. §4356(2) the moratorium enacted on August 13, 2007 by Council Ordinance 07-249 shall be extended until December 1, 2007.
