Item/Subject: Ordinance, Extending Moratorium on Development in the Waterfront Area
Responsible Delaa n nt City Council
The City enacted a moratorium on development in the waterfront area on August 13,
2007 by Council Ordinance 07-299. The moratorium was retroactive to July 17, 2007
and effective through November 1, 2007. There have been several discussions at
Council Committees an proposed changes to the Cltys Land Development Cade to
address the Issues which gave rise to the need for a moratorium. As a result, a number
of Ordinance amendments have been referred to the Planning Board, including a
proposal to rezone a number of parcels in the Summer/Main Street area to Waterfront
Development District. At its last meeting, the Planning Board tabled consideration of
one proposed ordinance change. In addition, public notice requirements for the
proposed restoring will result in the proposed ramping not being acted upon until after
the November I expiation of the moratorium. As a result, not all of the ordinance
changes that have been proposed will come before the Council for final action before
the expiration of the moratorium. State law provides that a moratorium can be
extended If the need for the moratorium continues to exist and the municipality has
made reasonable progress to alleviate the problems.
This Ordinance will extend the moratorium until December 1, 2007.
