Theludmn Heights Subdivision &pansion, phase 1, wasapproved brihe Bangor Planning Bask on
April 15, 2003. This residential subdivision is served by Pen vian Way, Lasalle Drhre, Hillview Ddve,
and Castle Hill. The Clty Engineer has determined that Peruvian Way, Lasalle Drive, Hillview Drive,
and Castle Hill have been satisfactorily completed.
The attached Order Is a routine action to formally accept tiese streets as a public ways

CITY OF BANGOR
(TITLE.) Order, Accepting Streets in Judson Heights Subdivision Expansion, Morse 1 — Peruvian Way,
Lasalle Drive, HIINiew Drive, and Castle Hill
WHEREAS, pursuant to 23 M.R.S.A §3025, property may be dedicated for highway, purposes only upon
certain conditions, among wMch are the "pmperty owner has Bled In the Reg" of Deeds
an approved subdivision plot plan which describes Property to be appropriated for public
use and that title W any such Property accepted by a municipality shall be fee simple; and
WHEREAS, pursuant to M M.RS.A. §3031 (1), `the public acquires rights of incipient dedication W
public use of the ways laid out on the piano frown `the date of recording of a subdivision pian
in The Registry of Deeds' and that such public rights egdre if the municipality does not
accept sad way within 20 years from date of recording of the subdivision plan; and
WHEREAS, the subdivision plan entitled Judson Heights Subdivision Exparsion, Mase I Final
SubdNision Mat, prepared by Shyha, Sheppard, & Gersten, deed February 3, 2003,
approved by the Bangor Planning Board on April 15, 2003, is recorded at the Penobscot
County Registry of Deeds in Map File, Man #200497 and 200998 on July 15, 2004; and
WHEREAS, there exists on the above referenced plan certain ways Identified as Peruman Way, Lasalle
Drive, Hillview Drive, and Castle HILI W be used by the public to access properties in this
subdivision; and
WHEREAS, said pudic ways on the above referenced plan have been Inspected by the City Engineer
and have been found W meet the City's standards and requirements for such pudic
improvements;
NOW, THEREFORE, BE R ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR THAT, pursuant
W 23 M.R.S.A. §3025 are §3031, (1) the ways referenced arq depleted on the subdivision plan
recorded in to Penobscot County Reg" of Deeds as revised and listed as follows +ere hereby
accepted as Pubile Ways and Streets by the City of Bangor:
Peruvan Way
Lasalle Drive
1Wiview Drive
Cattle HILI
BE JT FURTHER ORDERED, THAT the name of the Accepted Public Ways shall be as listed above and
said way be added W the Official City Map, and the City is authorized to accept a deed to Peruvian
Way, Lasalle Drive, Hillview Drive, and Castle HILI in a form acceptable to the City Solicitor or Assistant
City Solicitor.
