Coffee Hill, LLC has requested tentative developer status on 2.25 acres of Lot 194 in Me BIA Commercial/
Industrial Park. Coffee Hillis investigating developing a new office building for lease to a professional service
business. The property was selected for it location, development potential, and accessibility to the BAT.
Designating Coffee Hill as tentative developer would provide the company time to Investigate Me
feasibility of this project, prepare a deflmtive development proposal for Me City's consideration, and for
City staff M negotiate a proposed Development and Lease Agreement for ronsideratlon by Me City
Council, Mus Order would gram Coffee Hill exclusive status as developer of Me designated area until
November 26, 2007. Until Men, the City would deal exclusively with Mem regarding development of the
described area. This designation would gravide Coffee Hill an opportunity M submit for the Council's
consideaFion a more specific proposal for As proposed development sufficient in detail to outline the
general scope of development and convey to the City adequate information to determine Me level of
inveshnent proposed and character of Me work M be performed. Staff would also be authorized to

Staff recommends approval of tentative development agreement for ninety (g0) days.

CITY OF BANGOR
(TITLE.) ORDER, Designating Coffee Hill, LLC Tentative Developer of 2.25 Acres of
Lot 14-1 In the HIM Commerdal/Industnal Park
WHEREAS, Coffee Hill, LLC has requested designation as "Tentative Developer" of 2.25
acres of Lot 14-1 in the BIA Commercial/lndus[rlal Park in order to investigate
the feasibility of constructing an office building, allow time In prepare a definitive
development proposal, and for City staff to negotiate a proposed Development
and Lease Agreement for consideration by the Gly Council; and
WHEREAS, the City has granted "Tentative DevelopeY status to potential developers on
various City owned development sites in the pas[, thereby providing the
developer time to prepare a specific development proposal for the City CounciYs
consideration and during which time the Gty agrees to deal exclusively with the
designated tentative developer for the purpose far which tentative developer
status was granted;
NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR
THAT
Coffee Hill, LLC is hereby designate the tentative developer of 2.25 acres of Lot 14-1 in the BIA
Commercial/Industrial Park, as described In an attachment hereto, and that such designation is
in effect until November 26, 2007.
BE IT FURTHER ORDERED THAT:
1. During the period of designation the City agrees m deal exclusively with Coffee Hill, LLC
regarding the designated property for me purpose for which tentative developer status
was granted
2. Coffee Hill, LLC shall have until November 26, 2007 to prepare and submit in writing to
the OWS Director of Community & Economic Development a definitive proposal for the
development of an office building Por review by the Business and Economic
Development Committee of the City Council. The proposal submitted for the City's
consideratiion shall besuficient in detail to outline the scope and quality of
development and convey sufficient information for the City to determine the level of
inveshnnt proposed and character of the work to be performed. The proposal is to
Include a preliminary site plan showing:

(a) the footprint of the building and site improvements in relationship to boundaries
and topography, of the site and surrounding improvements and showing the
parking layout and proposed entrances and exits to the site;
(b) suitable cross-sections and elevations of the proposed building and
Improvements showing the relationship of Floors to surrounding grades and
indicadng the number of stories of the building and exterior building materials
proposed to be used to enable the City to evaluate the proposed building and
improvements; and
(c) preliminary floor plans showing the general layout; and uses, includng proposed
building entrances and exits and overall floor area for each Flow.
3. City staff is authorized to negotiate a Development and Lease Agreement with Coffee
Hill, LLC for the Business & Economic Development Committee's mnsideration setting
forth the proposed terms and conditions under which the proposed development would
be allowed to move (onward. The Development and Lease Agreement, if approved by
the City Council, would ensure that the development would conform to building plans,
site plans, and uses approved by the Business & Economic Development Committee and
that Coffee Hill, LLC demonstrates the financial capacity and ability to any out the
development as approved.
