Commentary:
Arnold Fessenden of FGS/CMI, Inc., Fessenden Geo -Environmental Services Construction Materials
Testing, Is seeking tentative developer status of the City owned Building #26 located at 113 Maine Ave.
Building #26 Is a vacant, one story, 4,(1 square foot brick building that was part of the former
University of Maine System Chancellor's complex on Maine Avenue where it was used for storage.
FGS/CMF, Inc. is interested in expanding its business and would IIIc• to Imestigate the necessary steps to
rehabilitate Building #26 for Its business use. Designating FGS/CMT, Inc. as tentative developer would
provide the comparry time to investigate the feasibility of rehabilitatlrg the building. This Order wmuld
grant MS/CMF, Inc. exclusive status as developer of Building #26 unBl September 24, 2007. Urdll than,
the City would deal only wM FGS/CMT, Inc. for development of the building. This designation would
provide FGS/CMT, Inc. an opportunity to submit for the City Council's considemtion a more specific
proposal for its proposed development in sufficient detail to outline the general scope of development and
convey to the City adequate information to determine the level of investment proposed and character of
the mrk to be performed. Staff would else be authorized to negotlate a Developmerd Agreement Wth
FGS/CMT, Inc. for the Clry Council's comideratlon on or before September 24, 2007 setting forth the
proposed terms and conditions under which the proposed development would be allowed to move
forward.

#26 at 113 Maine Avenue
WHEREAS, FGS/CMT, Inc., Fessenden Geo,Environmental Services Construction Materials
Testing, is interested In expanding and would like to Investigate the necessary
steps be rehabilitate Building #26 at 113 Maine Avenue for Its bulsness use; and
WHEREAS, Designating FGS/CMT,Inc. as"tentative developer'of Building#26 would
provide it the time necessary to investigate the feasbility of rehabilitating the
building her its use, prepare a definitive development proposal, and for Qty staff
W negotiate a proposed Development Agreement for consideration by the City
Council; and
WHEREAS, the Cry has granted "tentative developer' status to potential developers on
various Cry owned development rtes in the past, thereby providing the
developer time to prepare a spedfic development proposal for the Clry Coun ll's
consideration and during which time the City agrees to deal exclusively with the
designated tentative developer for the purpose for which tentative developer
status was granted;
NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CHT OF BANGOR
THAT
FGS/CMT, Inc. is hereby designated the "tentative develi of the City owned Building #26
located at 113 Maine Avenue and that such designation is in effect until September 29, 2007.
BE H FURTHER ORDERED THAT:
1. During the period of designation One City agrees to deal exclusively with TGS/CMT, Inc.
for the purpose for which tentative developer status was granted.
2. FGS/CMT, Inc. shall have until September 12, 2007 to prepare and submit in writing to
III CINs Director of Community and Economic Development a definitive proposal for
the rehabilitation and use of Building #26 by FGS/CMI', Inc. for review by the Business
and Economic Development Committee of the City Council no later than September 19,
2007. The proposal submitted for the OWs consideration shall be sufficient in detail to
outline the scope and quality of development and convey suffident information for the
City to determine the level of investment proposed and the character of the work to be
performed. The proposal is to include a preliminary site plan showing:

(a) the footprint of the building and site improvements in relationship to boundaries
and topography of the site and surrounding improvements and showing parking
layout and proposed entrances and exits to the site;
(b) suitable crosssections and elevations showing proposed Wilding Improvements
and exterior building materials proposed ro be used to enable the City to
determine the compatibility of proposed building improvements to the covenants
of the Maine Business Enterprise Park, and
(c) preliminary floor pans showing the general layouts and uses, Including proposed
building entrances and exits and overall floor area for each floor.
3. City staff is authorized to negotiate a Development Agreement with FGS/CW, Inc. for
the Blueness and Economic Development Committee's consideration on or before
September 19, 2007 and for the City Council§ consideration on or before September 24,
2007 setting forth the proposed [elms and conditions under which the proposed
development would be allowed to move forward. The Development Agreement, if
approved by the City Council, would ensure that the development would conform to
building plans, site plans, and uses approved by the Business and Economic
Development Committee, and that FGS/CFR, Inc. demonstrates the financial capacity
and ability to carry out the development as approved.
