Item/Subject Resolve, Reallocating the Designated Area of Bangers Pine Tree Zone

Commentary:
HEARING - Prior to voting on the Resolve, the Council is required to hold a Public
Nearing on the amendment to the Bangor Pine Tree Zone.
This Resolve wN amend the City's Pine Tree Zone area. Maine Secure Composites, LLC has requested
that the Bangor Pine Tree Zone be amended to include a parcel on Tax Map R8 Wt SF. Maine Sewre
Camposkes will be leasing a 4,200 sq. ft building on the 4.37 acre lot at 154 Hildreth St. North to
manufacture composite shipping containers. Maine Secure Composites has worked collaboratively with
the University of Maine over the last two years to design and prototype an Intrusion resistant composite
shipping contalner under a US Department of Homeland Security (DHS) compact. During that period,
Marne Secure Composites has operated from the Taget Technology Center. The shipping container Is
designed to be lighter Nan current steel containers, Incorporate an Imbedded security system to detect
intrusions, and have lower maintenance costs.
Maine Secure Composites currently employs five (5) full time and six (6) part time employees. They
expect to have ten (10) employees by the and of the testing and evaluation phase in about two years.
This item has been reviewed and is recommended for approval by the Busiress & [Economic Development
Committee.

(TITLE.) Resolve, Reallocating the Designated Area of Bangor's Pine Tree Zone
WHEREAS, the City of Bangor by Council Resolve 09-189 designated approximately 350
acres located in Bangor, Maine as a Pine Tree Zone; and
WHEREAS, the City of Bangor has agreed to maintain at least one pre -permitted
development site within the Pine Tree Zone on a continual basis throughout the
ten of the zone designation, but only M the extent that property so designated
remains available for development; and
WHEREAS, the City of Bangor hereby finds and determines that the purpose of this
amendment to the Bangor Pine Tree Zone designated! area Is M more effectively
encourage business Investment in Bangor in order to provide new employment
opportunities, improve existing employment opportunities, improve and broaden
the tax base and improve the general economy of the state; and
WHEREAS, Me City of Bangor has resolved not to use Pine Tree Development Zane benefits
M encourage or facilitate the transfer of existing positions or property of a
qualified business or affiliated business to a qualified business activity from a
nonqua0fied aOvity elsewhere in the State; and
WHEREAS, on October 26, 201 the State of Maine, Department of Economic and
Community Development, notified members of the Penobscot Valley Pine Tree
Zone (PVPFZ) Mat the WPTZ had achieved final designation status; and
WHEREAS, Me City of Bangor by Council Resolve 06-033 and Counal Resolve 07-061
amended Me location of the approximately 350 acres located in Bangor, Maine
as a Pine Tree Zone; and
WHEREAS, Maine Secure Composites, LLC has requested that a parcel of land on Tax Map
RS LM 1F, 4.37 acres, be included in Bongoes Pine Tree Zone; and
WHEREAS, one or more of the qualified business adivibes specified in Me Pine Tree
Development Zone statute, 30-A MRSA c 206 sub -c. 4, is a permissible and
suitable activity on Tax Map R8 Lot 1F under the land use regulations adopted
by the City of Bangor; and
WHEREAS, Maine Secure Composites, LLC has applied for certification as a business eligible
for Pine Tree Zone benefits; and

WHEREAS, the property on Tax Map R8 Lot ] and Lot 11 will be removed from Bangor's
Pine Trae Zone and the total acreage of Bangor's Pine Tree Zone will remain at
approximately 350 acres; and
WHEREAS, the City of Bangor has held a public hearing, notice of which was published In
the Bangor Daily Hews M least ] days before the hearing, on the inclusion of the
parcel on Tax Map R8 Lot 1F in Bangor's Pine Tree Zone; and
WHEREAS, the Gty, of Bangor has kept an official record of the public hearing at which the
reallocation of the area of the Bangor Pine Tree Zone was discussed:
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
BANGOR THAT
The City of Bangor removes the property described on Tax Map R8 Lot ] and Lot 11 from
Bangor's Pine Tree Zone and designates the parcel of land described on Tax Map R8 Lot IF as
part of Bangor's Pine Tree Zone to be included in the Penobscot Valley Pine Tree Zone and
hereby authorizes the me administrator, EMDC, 90 Harlow Street, Bangor, Maine 09401, a
private non-profit regional development agency, to properly submit on behalf of the City of
Bangor this Resolution be amend the boundary area of the Bangor Fine Tree Zone to the
Commissioner of the Department of Economic and Community Development pursuant to Maine
Deparbnent of Economic and Community Development, 19.100 CMR 19-100-100.5 am! further
authorizes a letter of transmittal to the zone administrator as required by Maine Department of
Economic and Community Development, 19 100 CMR 19-100-100.5
