Item/Subject: ORDER Amending Chapter 165 Article XN of the Land Development Code of
the City of Bangor, Conditional Use in the High Density Residential District

Commentary:
The High -Density Residential District (HOP) currently allows group housing, Including subsidized housing
for the elderly, congregate housing or other :e ntrandem housing faalibes, provided that no building
contains more than 50 dwelling units. Currently the Code allows buildings to be connected to other
buildings with at -grade enclosed walkways. This proposed amendment to conditional uses In HDR would
also allow above exam enclosetl walkways, provided they meet the following proposed ontena:
[1] MUR Only be used for accessory use ingress and ogress between multi -family structures,
[21 May be of single or multistory design,
[3] Must he designed wit a minimum of 50% glazing per exterior wall. The glazing of said
walkways must not be found by to Board to be darkened or made re0ecrve in a way that would
be noticeable from to building's exterior,
[4] Most net exceed 10 feet in width,
[5] Most be onset from large exterior facades of to buildings that they connect, and
[6] Must use roof treatment that minimizes their exterior bulk and must not appear to expand
the roo0ines of the primary use structures.

That Article MV, Section 165-100, Subsection D(4)(b) be amended as follows:
(4) Group housing including subsidized homing for the elderly, congregate housing or other

Subject: Planning Board Action on Toning Amendment
Please be advised that the Planning hoard held a Public Hearing on Ordinmwe 00-82 as amended
by sub inion at its regularly Kc Wed meefing on January 18, 2000. The Board found that the
Columnar Amendment is consistent with the City's overall land use policy forthis District
The Board moved, seconded, and unaWmously approved a motion to inform the City Council
Naz the Amendment is consistent with the City's Comprehensive Plarc and recommends to the
City Council approval of Ordinance 00-82 of the Land Development Cade with one word
substitution as indicated below. The full Amendment is included as an attachment.

The fallowing is an excerpt from the January 13, 2000 Staff Memo to the Planning Hoard:
This zoning amendment would allow buildings used as group housing facilities in the High
Density Residential District to be connected with single or muhi-story enclosed walkways. The
HDR District allows group housing structures, including subsidized housing for the elderly,
congregate housing or other non -transient lousing facilities, with up to 50 dwelling units m be
connected with enclosed walkways. The current ordinance pemdts at -grade or subgmde
enclosed walkways, but not above grade walkways.
The proposed amendment would allow for greater design options to improve access between
buildings used for elderly or congregate housing, while maintaining the function of the structure
as a rnrmector (only) between buildings. Specific design standards are incorporated into the
amendment to require that walkways be used only for ingress and egress between structures, do
not add'Yisual weight' m the complex, convey the appeam s,a of visual separation of the
walkways and buildings, and arc of a width, bulk and material composition (50% glass) to be
clearly connecting (not primary) structures.
Allowing for multi-level enclosed walkways that facilitate movement of the elderly and
bandiczpped, especially in inclement weather conditions, would promote the health, safety end
welfneofthesepopulations. With an aging population in the Hangar area, demand for group
housing facilities will likely increase in the future. Providing for greater design flexibility in
group housing in the High Density Residential District with respect to enclosed walkways seems
logical and appropriate at this time. Staff recommends that the Planning Board recommend Us
zoning amendment to the City Council.
