Necessary for Acquisition of Cruise Boat

On March 12, 1998 the Bangor Packet E Steamship Co. and Marine
Transportation, Inc. entered into a two-year lease/purchase
agreement for the operation of a cruise boat. The City provided
financial assistance to Bangor Packet. The City also took a
collateral assignment Of lease. In the Spring of 1999 Bangor
Packet notified the City that it did not intend to continue with
the lease. The City, pursuant to the collateral assignment of
lease, assumed the responsibilities of the lease/purchase
agreement•
The agreement provided that the Lessee has the right to purchase
the cruise boat for $118,000 at the end of the 1999 season. The
City has offered and Marine Transportation, Inc. has accepted a
purchase price of $108,000. This Order will authorize the purchase
of the cruise boat for that price. -

WHBRBAB, the City of Bangor, by virtue of a Collateral Assignment
of Lease, is Lessee of a Lease/Purchase Agreement with Marine
Transportation, Inc. for the use and operation of a cruise boat;
and
WHEREAS, said Agreement provides that Leasee shall have an option
to purchase said cruise boat; and
MEtBA.4, the City of Bangor has notified Marine Transportation,
Inc. of its intent to exercise its option to purchase said cruise
boat; and
WHEBBAS, Marine Transportation, Inc. has accepted the City of
Bangor's offer to purchase said cruise boat,
Now, THBHBPOHE, By the City Council of the City of Bangor be it

THAT the City Manager is hereby authorized, on behalf of the City
of Bangor, to execute all documents necessary to purchase the
cruise boat, more particularly described as Liberty Belle 0205499,
from Marine Transportation, Inc. for the Pum of $108,000. Said
documents shall be in a form approved by the City Solicitor or
Assistant City Solicitor.
