The Testing Policy is required by the Federal Government in order to be eligible for federal transit funding, which is received annually. - The amendments reFlM changes to the Cade of Federal Regulations that have occurred since 2006, when the PWicy was last updated. The Policy is being remsed in anticipation of a fedeal program audit that will be occurring this summer. The changes are primarily housekeeping in nature, and have been recommended by Precision Compliance, the firth engaged by the State Department of Transportation to assist recipients in preparing for the Program Audit. These positions Include transit drivers and supervisors and bus mechanics and supervisors. The last time the policy was updated as in July 2006. (Council Order 06- 293). The FTA will be undertaking a program review and audit this summer at the Recipient Level (Maine Department of Transportation) and Sub -recipient level (municipalities and other Federally subsidized transit providers). The City of Bangor, as operator of The BAT/Community Connector transit system will be part of the upcoming progmm review and audit Once again, the State has engaged the firm Precision Compliance to assist with reviewing all FTA Drug and Alcohol testing policies in the State prior to the program. audit. Given that the entire Policy was rewritten in 2006, there are only a few housekeeping changes that have been recommended to be made this year. These primarily deal with changes in law, which have occurred over the past five years. The attached policy includes the proposed amendments recommended for Inclusion by Precision Compliance. Staff involved with administering the Policy has reviewed and concurs with the proposed changes, and recommends approval by the Government Operations Committee.
