Commentary:
David Brown, who lives at 36 Larkin Street, has allowed tax liens M mature on 36 Larkin Street
and 34 Holland Street. In May 2010, Me Council condemned the property located at 34 Holland
Street; and on Apol 24'^, the Council rejected a final proposal from Mr. Brown to rehabilitate and
pay the nn Lara i liens at 34 Holland Street.
The city policy requires that a property owner cannot be In arrears on any debt awed the City
before the city will discharge liens. As a result of a previous court action related to 34 Holland
Street, Mr. Brown owes the CRy $14,240 In accumulated fines in addition to the taxes on both
Holland and Larkin Street. The Finance Committee has recommended disclwrging Me fine If Mr.
Brown pays the taxes owed on 36 Larkin Street and gives the City a deed for 34 Holland Street.
Should Mr. Brown agree to the terms described above, the Gty will release its interest In 36
Landn Street.
The Finance Committee has reviewed! this Item and unanimously recommends It for full council
consideration.

CITY OF BANGOR
(TITLE.) ORDER, Authorizing Acceptance of Payment for 36 Larkin Street, Acceptance of
Quitclaim Deed for M Holland Street, and Execution of Municpal Quitclaim Deed for 36
Larkin Street
WHEREAS, tax liens have been allowed to mature on the properties at 36 Larkin Street and 39
Holland Street by David Brown, who lives at 36 Larkin Street;
WHEREAS, the building on the property at 39 Holland Sheet Is in a state of disrepair and has
been concemned;
WHEREAS, Mr. Brown also owes the Oty for fines accumulated over several years of failure to
bring 39 Holland Street up to Cade standards; and
WHEREAS, in exchange for the City providing a quitclaim deed for 36 Larkin Street, Mr. Brown
has agreed to pay the taxes owed on 36 Larkin Street and to provide the City with a
quinclam deed for 39 Holland Street.

ORDERED,
THAT the Gty Tax Collector is hereby authorized to accept payment of $6090.00 in payment for
taxes owed on 36 Larkin Street, and the City Solicitor is authorized to accept a quitclaim deed
from David Brown releasing any interest he may have in real estate located at M Holland
Street. Said deed shall be directed to the City of Bangor in a form acceptable to the City
Solicitor or Assistant City Solicitor; and
BE IT FURTHER ORDERED THAT
Should the City receive both the aforementioned tax payment and quitclaim dead, Deborah A.
Cyr, Finance Director, is hereby authorized and directed, on behalf of the City of Bangor, to
execute a Municipal Quitclaim Deed releasing any interest the City may have by virtue of tax
liens recorded In the Penobscot County Registry of Deeds in Book 1210, Page 230 and Book
118D1, Page 309. Said deed shall be directed to David Brown in a form approved by the City
Solicitor or Assistant City Solicitor, The City Manager shall then be authorized to execute a
document discharging any fines assessed against Mr. Brown as a result of the Stipulated
Judgment approved by the Bangor District Court on October 11, 2006 in case number BAHDC-
CV-2006-325 which have not already been Paid.
