ORDER, Authorizing Execution of Agreement For Consulting Services Between the City of Bangor and Maine Governmental Relations WHEREAS, the Maine Legislature will consider changes W Maine's gaming laws; and WHEREAS, any changes may have a direct impact on the City of Bangor; and WHEREAS, E is in the best interest of the City of Bangor to hire a consultant/lobbyist to represent its interests before the legislature. BETWEEN THE CITY OF BANGOR MAINE and MAINE GOVERNMENTAL RELATIONS In accordance with the terns and conditions stated herein, Maine Government Relations thereinafter `the Consultant") agrees to perform consulting services in regard to gambling issues, regulations, rules and/or legislation of concern to the City of Bangor (hereinaR.ar'the City"). The tens of the services will commence as of January 3, 2011 and will terminate with the final disposition of the gambling issues in the 2011 Legislative Session or at the convenience of the City. The services provided will include, but may not be limited to, the following (hereinafter referred to as the "Legislative Session Services"). Assist Bangor City Officials and, at the request of the City, other interested parties with the development and implementation of strategic plan regarding the identified gambling issues and priority bills. Schedule meetings with key leghdatars and legislative staff to educate and shape opinion regarding identified legislation and issues of interest to the City. Maintain regular contact with legislators, executive branch agency staff and the Administration on designated issues continuously advocating and representing the City's position. Provide analysis of legislation, amendments and other relevant communications to the City. Attend and participate in committee hearings, work sessions and meetings of interested parties on designated bills. Track the progress of all such legislation, from the point of drafting that final disposition. provide weekly legislative session reports to City Officials (with additional as needed reports) on the progress of designated bills and other pertinent activities requiring the City's action, input, or decision. Advise the City on appropriate legislative strategy adusnnems throughout the session as developments affect the progress of designated legislation and issues. The Consultant will report to the City of Bangor's City Manager and the City Solicitor on all legislative activities and admwstrative trusters that became part of the Agreement Compensation for legislative session services will be rendered at the We of $150.00 per hour for the term with the Consultant providing the City with monthly invoices on or about the 1st of each month. Direct costs will be compensated separately and will include travel, phone, fax, copying and mailing charges not to exceed $100 per month without prior approval of the City Manager. 11 060 Either the Consultant or the City may request the contract be amended or extended. Both parties must approve any extension or amendment of this agreement's term or services in writing. The Consultant is responsible for preparing and filing all regisnatioNreporting forms required by the State of Maine. The City will reimburse Consultant for any fee required for the lobbyist registration for Consultant's representation of the City. The City of Bangor and the Consultant enter into this Agreement with the clear understanding that Consultant will not agree to represent any other organization or emity that conflicts with the interests of the City during thereon of Us Agreement. Consultant's relationship to the City under this Agreement shall be that of an independent contractor and not an employee or agent Consultant shall not represent or hold itself out as having my relationship with the City other than that of an independent contractor This Agreement shall be construed m be in accordance with the substantive and procedural laws of the Stene of Maine.
