Fees Responsible Department: Legal Commentary: This year the Maine legislature approved legislation to make the sale and possession of consumer fireworks legal. The new law takes effect on January 1, 2012. The law includes a provision that allows municipalities to set a reasonable fee for a permit to sell consumer fireworks. Fees WHEREAS, the Maine legislature approved legislation to make the sale and possession of consumer fireworks legal; and WHEREAS, the new law takes effect on January 1, 2012; and WHEREAS, the law includes a provision that allows municipalities to set a reasonable fee for a permit to sell consumer fireworks. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR THAT, Chapter 85 of the Code of the City of Bangor be amended as follows: §85-4. Fees. It is the intent and purpose of this section to establish fees which shall bear a reasonable relationship to the costs incurred by the city in the administration and enforcement of this chapter, other applicable city ordinances and state statutes. A. To accomplish such purposes: (1) All fees and charges for licenses or permits shall be paid in advance at the time of application therefor to the City Clerk. (2) All fees submitted shall be retained by the City Clerk regardless of whether said license or permit is issued. B.
