The Bangor Fire Department will, under this agreement, serve as a
site for a clinical internship for Kennebec Valley Technical
College (KVPC). Students of KVTC will get some experience and meet
course requiements. The Bangor Fire Department will have a chance
to work with and evaluate possible future employees.

THAT Edward A. Barrett, City Manager, is hereby authorized
on behalf of the City of Bangor to enter into an agreement with the
Kennebec Valley Technical College for the purpose of being a
clinical resource site for students enrolled in Emergency Medical
Services training at Kennebec Valley Technical College. A copy of
said agreement is attached hereto.

CLINICAL INTERNENIP
MEMORANDUM OF AGREEMENT
THIS AGREEMENT, effective this day of
1997, is made by and between KENNEBEC VALLEY TRCiINICAL COLLEGE, its
officers and employees (hereinafter referred to as "COLLEGE"), and
BANGOR CITY FIRE DEPARTMENT, its officersand employees
(hereinafter referred to as "FIRE DEPARTMENT").
WHEREAS, the FIRE DEPARTMENT provides emergency medical
services ("EMS") to the citizens of Bangor; and
WHEREAS, the COLLEGE provides education for emergency medical
services personnel; and
WHEREAS, the COLLEGE desires to develop a clinical resource by
affiliating with the FIRE DEPARTMENT;
NOW, THEREFORE, the FIRE DEPARTMENT and COLLEGE enter this
CLINICAL INTERNSHIP MEMORANDUM OF AGREEMENT OAGREEN ") under the
following terms and conditions.
I. FIRE DEPARTMENT AGREES TO:
1. Accept a mutually agreed upon number of EMB students for
a clinical internship during periods of time scheduled
and agreed upon in advance and designated in the
curriculum plan.
2. When possible, schedule with the same preceptor those
students who will have multiple experiences with the FIRE
DEPARTMENT.
3. Provide practical learning opportunities in order to meet
the students' clinical objectives.
9. Make available to the COLLEGE appropriate clinical
resources necessary to implement the educational programs
of the COLLEGE, and the use of non -expendable equipment
and expendable supplies and services.
S. Maintain standards of patient care, supplies and

6. Appoint a Fire Department representative to coordinate
with COLLEGE the execution of this Agreement.
7. Reserve the right to terminate a student due to
negligence or misconduct as determined by the FIRE
DEPARTMENT and the COLLEGE. Any such termination will be
in writing to the COLLEGE.
8. Reserve the right to reschedule any student failing to
comply with the established dress code.
9. Meet with COLLEGE representatives at an agreed upon date
and time to discuss any matters regarding the internship.

10. To the extent of the limits of the FIRE DEPARTMENT'S
liability insurance, defend, indemnify and hold harmless
the COLLEGE from and against all claims, damages, losses
and expenses, excluding attorneys' fees, arising out o -
or sulting from the exercise of rights granted by thia
Agreement; provided thatanysuchclaim, damage, loss o
expense (a) is attributable to bodily injury, sickness
disease or death, or injury to or destruction of tangible
property; and (b) is caused in whole or in part by any
negligent act or omission of the FIRE DEPARTMENT.
II. COLLEGE AGREES TO:
1. Conduct an educational program i accordance with one
standardsof the Maine Technical College Board of
Trustees, Kennebec Valley Technical College and Maine
Emergency Medical Services.
2. Provide education for all students in appropriate
cognitive and psychomotor objectives prior to allowing
students to perform those skills in a clinical setting.
3. In cooperation with FIRE DEPARTMENT, identify preceptors
who will instruct and supervise internship students.
4. Provide to the FIRE DEPARTMENT a clinical experience plan
that will include a course syllabus, objectives and
documentation forms.
5. Schedule as early in ach semester as possible those
students who will participate in this internship.
6. Notify as far in advancespossible the FIRE
DEPARTMENT's representative of any cancellations cr
changes in student schedule.
2 Provide the FIRE DEPARTMENT with written documentation
that students have all the required immunizations against
Mumps, Rubella and Rubeola, Diphtheria, Tetanus and
Hepatitis e; as well as a recent (within previous year)
negative tuberculin (PPD) test or negative chest X-ray
(if prior positive PPD).
8. Adhere to FIRE DEPARTMENT's applicable policies,
procedures and standards of care, including the following
dress code for clinical internship:
A. Shirts with white or blue collars.
B. Dark blue or black pants.
C. Dark colored, safety -quality footwear.
9. To the extent of the limits of the COLLEGE'S coverage
under the Maine Tort Claims Act, defend, indemnify and
hold harmless the FIRE DEPARTMENT from and against all
claims, damages, losses and expenses,excluding
attorneys' fees, arising out of or resulting from the
exercise
of rights granted by this Agreement; provided
thatny such claim, damage, loss or expense (a) is
attributable to bodily injury, sickness, disease or
death, or injury to or destruction of tangible property
and (b) icaused in whole or in part by any negligent
act or omission of the COLLEGE.

III. INSURANCE REQUIRffi98NTS:
1. The COLLEGE will procure and maintain liability insurance
to the extent of the Maine Tort Claims Act during the
term of this Agreement, insuring both itself and the FIRE
DEPARTMENT as those terms have been defined in this
Agreement against liability arising out of negligent acts
or cions of the COLLEGE while acting under this
Agreement. Suchshall name the FIRE
DEPARTMENT, its officers, agents and employees, including
the FIRE DEPARTMENT's paramedic employees, as additional
insureds.
2. The COLLEGE will provide the FIRE DEPARTMENT with
certificates of insurance
r certified copies of the
applicable policies and willprovide thirty (30) days'
written notice to the FIRE DEPARTMENT of non -renewal,
material modification or cancellation prior to the
effective date of such non -renewal, modification or
cancellation.
3. The COLLEGE shall further provide evidence of workers'
compensation insurance covering its officers and
employees.
IV. AMENDMENT OR TERMINATION OR THIS AGREEMENT:
1. This Agreement may be amended upon consent of each party.
Any such amendment shall be in writing and attached
hereto and made a part of this original Agreement.
2. This Agreement may be terminated by either party for
convenience or cause. Said termination shall be
writing and effective upon receipt - of notice of
termination.
3. In the event of termination of this Agreement, the
students' educational program will be safeguarded. The
COLLEGE shall be granted the right to complete the period
of clinical internship with the FIRE DEPARTMENT for
students currently enrolled under the conditions as set
forth in this Agreement.
V. OTHER:
1. Nothing in this Agreement is intended to expand, limit o
otherwise change the scope or limits of liability set
forth by the Maine Tort Claims Act, 14 MRSA 9 5101, at
seq., or other state or federal law.
2. Students who become ill or injured during their clinical
internship will notify their clinical preceptor and the
COLLEGE's designated clinical coordinator. In the event
of illness or injury, the student will be directed to
follow the COLLEGE's and FINE DEPARTMENT's policies
related thereto.

VS. TERM OF AGREEMENT:
1. This Agreement will remain
in effect for a three (3) year
period from the effective date and shall be reviewed for
each subsequent annual period unless otherwise amended or
terminated by either party.

Agreement by their authorized representatives as set forth below.
