Commentary:
This ordinance amendment would clarify the City's Property Maintenance ordinance by
removing Section 223-3, Uninhabitable Buildings, and amending notice requirements in the
International Property Maintenance Code.
The City's Property Maintenance ordinance is based on the International Property Maintenance
Code (IPMC), with some modifications by the City. A separate section of the Property
Maintenance ordinance, § 223-3, imposes additional requirements for uninhabitable buildings.
The effect is that Code Enforcement must satisfy two separate processes that do not effectively
take each other into account, leading to potential confusion for both Code and property owners.
This ordinance amendment would clarify the City's process in addressing uninhabitable buildings
by using the IPMC procedure as adopted and modified by the City. This should give Code
Enforcement the flexibility to handle different situations and avoid confusion and delay on the
part of both Code and property owners. The amendment would also clarify IPMC provisions
regarding the timing of service of notice.
This item was recommended for approval by a 5-0 vote at the Business and Economic
Development Committee meeting on January 17, 2017.

ORDINANCE, Amending Chapter 223, Property Maintenance, of the Code of the City of Bangor, By
Clarifying Procedural Requirements for Handling Uninhabitable Buildings
WHEREAS, the City has adopted the International Property Maintenance Code, 2003 Edition (IPMC),
for dealing with property maintenance issues;
W"EREAS, a separate section of the City's property maintenance ordinance creates additional
requirements for the handling of uninhabitable buildings;
WHEREAS, as the City has increased its efforts to deal with vacant and uninhabitable buildings, it has
found that the differing requirements in the IPMC and the City's separate provisions have led to
confusion and delay; and
WHEREAS, notice posted at a property on or about the date a letter is sent should be considered
sufficient to fulfill a requirement that notice be posted if the letter is returned;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT
Chapter 223 of the Code of the City of Bangor be amended as follows.

The International Property Maintenance Code 2003 is adopted in its published farm as if fully set forth
herein, except as follows;
