The City's Property Maintenance ordinance is based on the International Property Maintenance Code (IPMC), with some modifications by the City. A separate section of the Property Maintenance ordinance, § 223-3, imposes additional requirements for uninhabitable buildings. The effect is that Code Enforcement must satisfy two separate processes that do not effectively take each other into account, leading to potential confusion for both Code and property owners. This ordinance amendment would clarify the City's process in addressing uninhabitable buildings by using the IPMC procedure as adopted and modified by the City. This should give Code Enforcement the flexibility to handle different situations and avoid confusion and delay on the part of both Code and property owners. The amendment would also clarify IPMC provisions regarding the timing of service of notice. This item was recommended for approval by a 5-0 vote at the Business and Economic Development Committee meeting on January 17, 2017.
