Commentary: �
Subject to certain exceptions provided for in the Code of the City of Bangor the use of
alcohol is prohibited in City parks and hours in the parks are limited. The City allows
the outdoor sale of food and beverages, including alcoholic beverages, by restaurants,
subject to sidewalk agreements with the City on City property and/or right-of ways
(sidewalks), immediately adjacent to the business. There is a business that provides
food and beverages, including alcoholic beverages, immediately adjacent to Pickering
Square Park and they have requested a '�sidewalk agreement", so-called, in order to
serve customers outside.
This Ordinance amendment, if approved, will authorize the use of alcohol in Pickering
Square Park pursuant to a separate agreement with the City and will, if approved, then
allow the City to enter in the a sidewalk agreement with the business.

WHEREAS, subject to eertain exeeptions provided for in the Code of the City of Bangor the use
of alcohol is prohibited in City parks and hours in the parks are limited, and
WHEREAS, the City of Bangor a[lows the outdoor sale of faod and beverages, including
alcoholic beverages, by restaurants, subjee� to agreements with the City on City
property or right-of ways (sidewalks}, immediately adjacent tQ the business; and
WHEREAS, there is a business that provides food and beverages, ineluding alcohofic
beverages, immediately adjaeent to Pickering Square Park.
BE IT 4RQAINEQ BY THE CITY GQUNCIL QF THE CITY OF BANG�R, THAT
Chapter231, Section 231-7 and Chapter 231, Section 231-9 af the Code of the City of Bangor
be amended as follows:
§231-7. A[coholic beverages; fires; use of closed areas.
A. Intoxicating beverages.
(1) Unehanged.
(2) Unchanged.
(3) Exceptions. At the Municipal Galf CQurse, Bass Park, Piekering�uare Park, and West
Market Square, eoncession and license privileges may inc[ude the sa[e of fiquor by such
concessionaire or licensee under strict regulation and eantrol of�he City Council. Sales of liquor
at such locations shal[ be made only in individual drinks (not in bulk), and liquor shall be
served ortly for consumption on the immediate premises of the coneession and in such other
areas as the City Council may direct. In addition, in accordance wit[� the applicable provisions
of state law, alcohol may be served at locations throughQut the Munieipal GQIf Caurse under
terms and conditions established by the Director of Parks and RecreatiQn.

§231-9. Park operating poiicy.
A. Hours. With the excep�iQn of Piekerinc� Sc�uare Park� West Market SQuare Park, Bass
Park and the Municipal Golf Course and except as provided in Subsection B below, all parks, as
defned herein, shall be open to the public every day of the year from 6:OQ a.m. to 10:00 p.m.,
Eastern standard time or Eastern daylight time, as may be then in effeet by virtue of 1
M.R.S.A. §151. Access by the publ�� to the Municipal Golf Course and Bass Park shall be at
such hours and on such conditions as r�a�r be established by the City Couneil. In the event that
activities are condueted at eith�r the Municipal Golf Course or Bass Park for whieh there is an
admissian fee charged, no member of the pubiic shall have the right to enter said park areas
without payment of sueh admissian fee. The Direetor shall cause nQtices of the opening and
dosing hours to be posted in each individua[ park for publie informatian purposes.
