Commentary:
Forest H. Grant Family Limited Partnership owns a parcel of land on Stillwater Avenue as described in the
attached Easement Deed. The Order would authorize the execution of an Easement Deed for the purpose
of providing a pedestrian sidewalk.

WHEREAS, Forest H. Grant Family limited Rartnership and the City af Bangar enter into an
� easement agreement for the purpose of a pedestrian sidewalk; and
� By the City Counci!of the City of Bar�gor.

That Catherine M. Canlow, City �ianager, is hereby authorized on behalf af the City of Bangor
� to execute agreement with Forest H. Grant Family Partnership for an easement agreement far
the purpose af a pedestrian sidewalk on Stillwater Avenue. Said Agreement shall be in a final
farm as appraved by the Gity Solieitar or Assistant City Soiicitor.

I EASEMENT DEED �
' Forest H. Grant Family Limited Partnership, a Limited Partnership, organized and
existing under the laws of the State of Maine located in Bangor, County of Penobscot,
' State of Maine, Grantor, grants to the City of Bangor, a municipal corporation located in
Penobscot County, State of Maine, Grantee,the rights,privileges and easements to enter,
' construct, maintain, repair a sidewalk for public pedestrian use, subject to any restrictions
contained herein, over and across a certain lot or parcel of land situate in the City of
� Bangor, County of Penobscot, State of Maine, more particularly described as follows:
Beginning on the northwesterly line of Stillwater Avenue in said Bangor, at an
iron marking the southeasterly corner of land described in a deed to Richard J.
Allen recorded in Penobscot County Registry of Deeds volume 3497, Page 226;
, thence along the northwesterly line of Stillwater Avenue North 31 03' 00" East, a
distance of 155.0 feet to a point; thence North 52 27' 30" West, a distance of 6.0
� feet to a point ;thence South 31 03' 00" West a distance of 155 Feet more or less
to the north easterly property line described in the aforementioned deed to by
Richard J. Allen; thence along the north easterly line of said Richard J. Allen land
South 52 46' 45"East a distance of 6 feet more or less to the point of beginning.
� The easement herein granted shall consist of the right to enter onto the above-
described easement area and onto adjacent land of the Grantor at all reasonable times
' with personnel to maintain and use within the easement area for a sidewalk for public
pedestrian use.
The Grantor agrees, for itself and for its successors, heirs and assigns,that
no trees, shrubs or permanent structures will be planted or constructed within the
easement area as described above, but Grantor otherwise reserves the use and enjoyment
of its property.
IN WITNESS WHEREOF the said Forest H. Grant Family Limited Partnership
has caused this instrument to be signed this day of , 2012.
