Responsible Department: Legal Commentary: In the 1960's real estate tax liens were filed on the property of Hugh Davis Sr. now owned by Brohill, LLC. At some point the taxes were paid but discharges of the liens were never recorded. Therefore a municipal quitclaim is required to clear title to the property. Order, Authorizing Execution of Municipal Quitclaim Deed — A Portion of Real Estate Located at Stillwater Avenue. By the City Council of the City of Bangor. ORDERED, that Deborah A. Cyr, Finance Director, is hereby authorized and directed, on behalf of the City of Bangor, to execute a Municipal Quitclaim Deed releasing any interest the City may have by virtue of undischarged real estate tax liens recorded in the Penobscot County Registry of Deeds in Book 1892, Page 183, Book 1947, Page 303, Book 1996, Page 365, Book 2050, Page 61, Book 2100, Page 388, Book 2129, Page 659, Book 2158, Page 221 and Book 2184, Page 565. Said deed shall be in substantially the same form as attached hereto and in a final form as approved by the City Solicitor or Assistant City Solicitor. MUNICIPAL QUITCLAIM DEED The CITY OF BANGOR, a municipal corporation located in Bangor, Penobscot County, State of Maine, as Grantors, for consideration paid, releases to BROHILL, LLC, a Maine limited liability company, Grantee, successor in interest to Hugh Davis, Sr. a certain lot or parcel of land together with the improvements thereon located in Bangor, Penobscot County, State of Maine, bounded and described as follows: A certain lot or parcel of land, together with any improvements thereon, situated in Bangor, Penobscot County, Maine, bounded and described as follows: Commencing at an iron rod set in the ground on the generally westerly side of the Kittredge Road, so-called, in said Bangor at the generally easterly corner of land now or formerly of J. Fish; thence South seventy-seven degrees twenty-four minutes thirty seconds West (S 7'24' 30" W) five hundred thirty-six and seventy- four hundredths (536.74) feet, more or less, to an iron rod set in a stone wall on the generally easterly line of land now or formerly of Lane; thence South fourteen degrees fourteen minutes zero seconds East (S It 14'00" E) by and along said rock wall marking Lane's generally easterly line three hundred and twelve hundredths (300.12) feet, more or less, to the generally westerly corner of land now or formerly of Paroleo Dairy Farm, Inc.; thence North seventy-seven degrees twenty-four minutes thirty seconds East (N 7f 24' 30" E) five hundred twenty- nine and eleven hundredths (529.11) feet, more or less, to a point on the generally westerly line of said Kittredge Road; thence North twelve degrees forty-six minutes thirty seconds West (N 1'46' 30" W) by and along the generally westerly line of said Kittredge Road three hundred (300) feet to the point of beginning. I., Inc., Pension Plan to Bangor Inn Associates, dated August 31, 1988, and recorded in Book 4299, Page 277 of the Penobscot County Registry of Deeds, being bounded and described as follows: Commencing at an iron rod set in the ground in the generally westerly side of the Kittredge Road, so-called, in said Bangor at the generally southeasterly corner of land now or formerly owned by J. Fish; thence westerly by and along the land of said J. Fish and land now or formerly owned by M. Fish, South seventy-seven degrees twenty four minutes thirty seconds West (S 7f24' 30" W) three hundred fifty and twenty-five hundredths (350.25) feet to an iron rod set; thence South twenty-eight degrees eighteen minutes thirty-five seconds East (S 2:� 18' 35" E) three hundred eleven and sixty-five hundredths (311.65) feet to a point in the northerly line of a parcel of land described in a deed from Paroleo Dairy Farms, Inc to BEV, Inc. dated June 11, 1985, recorded in the Penobscot County Registry of Deeds in Book 3672, Page 101; thence by and along the said northerly line of 12 176 said BEV, Inc. land, North seventy-seven degrees twenty-four minutes thirty seconds East (N 7f 24' 30" E) two hundred sixty-six and seventy-nine hundredths (266.79) feet to the said westerly line of the Kittredge Road, thence by and along the westerly line of the Kittredge Road, North twelve degrees forty-six minutes thirty. seconds West (N 1 T46' 30" W) three hundred (300.00) feet to the point of beginning, containing 2.125 acres. The purpose of this deed is to release to the Grantee all right, title and interest the Grantor may have in the above-described premises by virtue of undischarged real estate tax liens assessed against Hugh Davis Sr. and recorded in Penobscot County Registry of Deeds Book 1892, Page 183, Book 1947, Page 303, Book 1996, Page 365, Book 2050, Page 61, Book 2100, Page 388, Book 2129, Page 659, Book 2158, Page 221, and Book 2184, Page 565. All public easements or other public interests in the described premises for roads, sewer, or other purposes are expressly reserved.
