HomeMy WebLinkAbout2012-05-14 12-171 ORDERCOUNCIL ACTION Item No. 2 171 Date: May 14, 2012 Item/Subject: Order, Directing the City Manager to Take Possession of Property Located at 110 Pearl Street — Peter Brown and Jennifer Brown Responsible Department: Legal Commentary: The property of Peter and Jennifer Brown located at 110 Pearl Street, Bangor, Maine has outstanding property tax liens that have matured. In addition, the City of Bangor holds mortgages on the property and the mortgage payments are in arrears. The City and the Browns have entered into a work-out agreement for the payment of the outstanding taxes and mortgage arrearages. The Browns have failed to comply with the terms and conditions of the work-out agreement. As a result, the City is entitled to exercise its statutory right to take possession of the property because of the matured property tax liens. This Order, if approved, will direct the City Manager to take the necessary action to take possession of the property at 110 Pearl Street because of the matured property tax liens. This matter was reviewed by the Finance Committee and the Committee recommended approval. ORDER, Directing the City Manager to Take Possession of Property Located at 110 Pearl Street — Peter Brown and Jennifer Brown WHEREAS, the property located at 110 Pearl Street, Bangor, Maine has outstanding property tax liens that have matured; and WHEREAS, the City of Bangor holds mortgages on the property located at 110 Pearl Street and the mortgage payments are in arrears; and WHEREAS, the owners of 110 Pearl Street, Peter Brown and Jennifer Brown, and the City of Bangor executed a work-out agreement for the payment of the outstanding taxes; and WHEREAS, the owners of 110 Pearl Street have failed to comply with the terms and conditions of the work-out agreement. ORDERED, The City Manager, on behalf of the City of Bangor, is hereby directed to take all necessary and appropriate action to take possession of the property located at 110 Pearl Street because of the matured property tax liens.
