Willette Responsible Department: Legal Commentary: This Order will amend the Employment Agreement between the City of Bangor and Tracy A. Willette, Director of Parks and Recreation, signed in 2008. In 2008, the City entered into an employment agreement with Tracy A. Willette to serve as the Director of Parks and Recreation. At that time Tracy was residing in Brewer. The original employment agreement contained a common provision that required the employee to move to Bangor if he were to move from his home in Brewer. Tracy is considering buying a new home, but because he does not want to remove his children from the Brewer schools he wants to remain in Brewer. This Order will amend the residency provision to provide that Tracy may move from his Brewer residence to other Brewer residences during the term of his employment with the City, but that if he moves from the City of Brewer, he will move to Bangor. This is consistent with language being proposed in other employment contracts. ORDERED, that the Employment Agreement between the City of Bangor and Tracy A. Willette is hereby amended as follows: By deleting Section 10 and replacing it with the following: Section 10. Residency Employee currently resides in the City of Brewer, Maine and Employer has not required Employee to relocate to Bangor. Employee may move from his Brewer residence to other Brewer residences during the term of his employment with the City. However, if Employee should move from the City of Brewer, Employee will establish permanent residence within the corporate limits of the City of Bangor, and then would maintain residence in the City of Bangor for the term of his employment as Director of Parks and Recreation.
