HomeMy WebLinkAbout2012-03-26 12-124 ORDERCOUNCIL ACTION 12 1� Item No. Date: March 26, 2012 Item/Subject: ORDER, Authorizing the City Manager to Execute a Quitclaim meed for 24 Central Street to Betsy and Zeth Lundy Responsible Department: Community and Economic Development Commentary: Betsy and Zeth Lundy have expressed interest in purchasing 24 Central Street, sometimes called the Zoidis lot, from the City for $5,000. The City's Assessing Department and an independent review have confirmed that this is an appropriate figure given the encumbrances on the property. This Order would authorize the City to execute a quitclaim deed in favor of the Lundys. The deed contains a right of first refusal, meaning the City would have an opportunity to repurchase the property should the Lundys later choose to sell it. The property is in the Bangor Center Revitalization Area, commonly called the fagade district, so will have to abide by certain aesthetic requirements. The Business and Economic Development Committee recommends approval. IN CITY COUNCIL March 26, 2012 Passed IM CI LERK ORDER CMLE,)_Authorizing the City Manager to Execute a Quitclaim Deed for 24 Central Street to Assigned to Councilor Cvv L A- 124 QUITCLAIM DEED The City of Bangor, a municipal corporation located in Bangor, Penobscot County, Maine, as Grantor, for consideration paid, releases to Betsy and Zeth Lundy, Grantees, together with any improvements thereon situated owned by Grantor, a certain lot or parcel of land in Bangor, Penobscot County, Maine, more particularly described as follows, viz: A certain lot or parcel of land situated on the northwesterly side of Central Street in said Bangor, being the same premises conveyed by Effie Zoidis and others to the City by their several deeds dated February 8 to June 26, 1989 and recorded in the Penobscot County Registry of Deeds in Book 4515, Pages 345 through 361. Said real estate is further described in City records as Assessor's Map 41, Lot 65, Real Estate Tax Account Number 10899. Any and all other rights, easements, privileges and appurtenances belonging to the granted estate are hereby conveyed. The purpose of this deed is to release to the Grantees any interest the Grantor may have in the above-described property. All public easements or other public interests in the described premises for roads, sewers, or other purposes are expressly reserved. Notwithstanding the above, in the event that Grantees shall receive from a third party at any time in the future a bona fide offer to purchase the premises described above at a specified price, and on specified other terms, and Grantees shall decide to sell the same for such amount and on such terms, Grantees shall give to Grantor written notice by certified mail of the terms of such offer and of Grantees' willingness to sell for the price and other terms offered and the Grantor shall have the first refusal and privilege of purchasing said real estate at the same price and under the same other terms and conditions as such offer. Should Grantor decide to exercise said privilege, Grantor shall exercise said privilege within 30 days after receipt by Grantor of the Grantees' notice by mailing written notice to the Grantees notifying the Grantees that Grantor will purchase said real estate for the amount and under the terms and conditions of such offer.
