Item/Subject: ORDER, Authorizing the City Manager to Execute a Collective
Bargaining Agreement between the City of Bangor and AFSCME Council 93
Representing Certain Employees at the Public Works Department

Commentary: Labor negotiations with AFSCME Council 93 representing approximately 60 Public
Works Department employees have resulted in a Tentative Agreement between the City and Union
Negotiating Committees. This agreement follows the June 30, 2010 expiration of the most recent
contract. The parties were assisted in the negotiation process by an independent mediator and a
factfinding panel assigned by the Maine Labor Relations Board. Contract changes include: a two-
year term ending June 30, 2012; continuation of the existing wage scales; updated health insurance
rates and revised language excluding new hires from election the Open Access Plus 100% health
insurance plan; safety boot allowance set at $220 for each year of the contract; revisions to the call-
in procedure for winter operations; revised language regarding the loss or suspension of an
employee's Maine Driver's License and/or Commercial Driver's License; clarifying language changes
concerning layoffs and compensatory time; and minor housekeeping changes such as date changes
and elimination of outdated language.
The Public Works Union has recently voted to ratify the Tentative Agreement. The Agreement has
been reached within the bargaining guidelines previously established by the City Council, and the
agreement has been reviewed with the Council in Executive Session. The Agreement is presented
with the recommendation of the Management Bargaining Committee. A copy of the Agreement will
be provided under separate cover.

ORDERED, that the City Manager is hereby authorized to execute a Collective
Bargaining Agreement between the City of Bangor and AFSCME Council 93 representing
certain employees at the Public Works Department for a term of two years commencing
July 1, 2010 and ending June 30, 2012 as has been provided to the City Council under
separate cover.
