HomeMy WebLinkAbout2012-01-23 12-071 ORDINANCECOUNCIL ACTION Item No. 12 071 Date: January 23, 2012 Item/Subject: Ordinance, Amending City of Bangor Code, Vehicles and Traffic, Chapter 291, §291-29 Schedule XVII Responsible Department: Engineering Commentary: The attached Ordinance would amend the City of Bangor Code, Vehicle and Traffic, Chapter 291, §291-29, Schedule XVII. The City Clerk's office holds a file on the list of streets to be posted for heavy loads in the spring. Changes to the Ordinance include the removal of certain streets that have become the responsibility of the Maine Department of Transportation and certain residential streets and roads that are no longer used for heavy vehicle traffic, such as Hancock Street. Also, proposed changes include insertion of language to authorize the City Engineer to determine the posting streets when possible damage to the street may exist. Additions to Ordinance are underlined and strike -through notes intended deletions. The Infrastructure Committee has reviewed and unanimously approved on January 17, 2012 to approve the amendment. Ordinance, Amending City of Bangor Code, Vehicles and Traffic, Chapter 291, §291-29 Schedule XVII BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR THAT A new Schedule XVII, Section 291-29 of the Code of the City of Bangor is hereby adopted as follows; SCHEDULE XVII, Vehicles and Traffic § 291-29. Weight limit on certain streets. During the period between November 1 and May 15, except when otherwise determined to be necessary by the City Engineer, no vehicle the gross weight of which (vehicle and load combined) exceeds 3 1/2 tons shall pass over the portions of highways within the City of Bangor designated in Schedule XVII or any City Street designated by the City Engineer, except when the surface of the road is solidly frozen. BANGOR, MAINE 04401 TEL: 207/9924501 A sure sign of spring is the annual appearance of the orange heavy loads limited signs that limit heavy trucks from using certain roads. Heavy trucks on some roads can lead to damage or premature wear of the road especially in the spring when the road base is saturated. Schedule XVII, on file in the City Clerk's Office, is a list of streets that we post for heavy loads every spring. This list was last revised in 1998 and includes many residential streets in the Hancock Street area that received some heavy truck traffic before Hancock Street was relocated. It also included some roads that are now the responsibility of MDOT. This 1998 list contained 18 streets in the City of Bangor. Public Works has been annually posting 7 streets which are listed in the proposed revised Schedule XVII list. While this list includes the roads that we know will need to be protected from heavy truck traffic, some other streets may be vulnerable to damage due to developments or change in traffic patterns causing trucks to seek shortcuts. Staff also requests amending Ordinance 291-29, to allow the City Engineer to post any City street when the possibility of damage to the street by heavy truck traffic exists. Staff recommends amending Ordinance 291-29 and revising Schedule XVII as detailed in the attached document.
