HomeMy WebLinkAbout2012-01-23 12-068 ORDINANCECOUNCIL ACTION Item No. 1 2 068 Date: January 23, 2012 Item/Subject: Ordinance, Amending the Code of the City of Bangor, Chapter 33-2 and Chapter 265-4 (F) — Recycling Committee Responsible Department: Legal Commentary: If approved this Ordinance amendment will eliminate the Recycling Committee. When formed, it was anticipated that the Recycling Committee would evaluate recycling options for the City and provide alternatives to the current system. With much of the data collection and analysis complete, the Recycling Committee is no longer as necessary as it once had been. Therefore, it has been recommended that the Recycling Committee sunset until such time when more intensive work is needed. Recycling remains a function of the Public Works Department and issues regarding recycling will continue to be directed to the City Council's Infrastructure Committee. In the event that circumstances change so that a recycling committee would be of benefit to the City the City Ordinances can be amended to again establish the committee. This proposed amendment as been previously reviewed in a Council Workshop Session. Ordinance, Amending the Code of the City of Bangor, Chapter 33-2 and Chapter 265-4 (F) — Recycling Advisory Committee NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR THAT, Chapter 33, Section 33-2 of the Code of the City of Bangor be amended as follows: §33-2. Definitions. As used in this code, the following terms shall have the meanings indicated: BOARD -- Unchanged. BOARD MEMBER -- Unchanged. BUSINESS -- Unchanged. CITY COUNCIL -- Unchanged. CITY COUNCILOR -- Unchanged. CITY EMPLOYEE -- Unchanged. COMMISSION -- All committees, commissions or other public bodies now existing or hereafter created by virtue of any ordinance, order or resolve adopted by the Bangor City Council, including, without limitation, the following: A. Bangor Housing Authority Commission. B. Economic Development Advisory Commission. C. Firearms Discharge Committee. D. Harbor Committee. E. Historic Preservation Commission. F. Nursing Facility Advisory Committee. G. Parks and Recreation Advisory Committee. H. Reeyeling Committee. NOW, THEREFORE, BE IT FURTHER ORDAINED BY THE CITY OF BANGOR THAT, Chapter 265, Section 265-4 of the Code of the City of Bangor be amended as follows: §265-4. Recycling. 12 068 The City shall provide a curbside recycling program to residential units to which the City provides solid waste collection. The City shall also provide a dropofl" center open to all residents and commercial establishments In the City. The materials to be accepted in the recycling program shall be established by the Director of Operations and Maintenance. The City Council may, by order, establish fees for the acceptance of material generated by commercial establishments. In addition, the Director of Operations and Maintenance may refuse to accept materials from commercial sources If the type or quantities of such materials are beyond the City's financial or operational ability to appropriately respond.
