Item/Subject: Order, Authorization to Execute a Municipal Quitclaim Deed for the Sale of a
Portion of 34 Holland Street to Dale A. Ruopp

Commentary:
In 2011 the City acquired 34 Holland Street due to non payment of taxes and matured tax liens.
The building on the property was deemed unsafe and uninhabitable by the Code Enforcement
Officer and was demolished by the City. The lot is not a buildable lot under the City Code. Dale
Ruopp, an abutting landowner, is interested in purchasing a portion of the property to add to her
current lot. Upon receipt of payment of the land's value, $2,500, the City will issue a quitclaim
deed.
The Business and Economic Development Committee recommends approval.

WHEREAS, in 2011, the City acquired 34 Holland Street due to non payment of
taxes and matured tax liens, and;
WHEREAS, the Code Enforcment Officer deemed the property unsafe and
uninhabitable, the City demolished the building on said property using CDBG funds,
and;
WHEREAS, both abutting landowners are interested in purchasing a portion of
the property to add to their current lots; and
WHEREAS, the proposed disposition has been reviewed by the Business and
Economic Development Committee of the City Council which recommends approval.
NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF
BANGOR, THAT the Finance Director is hereby authorized, on behalf of the City of
Bangor to execute a municipal quitclaim deed to Dale A. Ruopp in a form as
substantially the same as attached hereto and in a final form as approved by the City
Solicitor or Assistant City Solicitor. Said deed shall be executed upon payment to the
City of Bangor by Dale A. Ruopp of $2,500.00 on or before February 1, 2012.

MUNICIPAL QUITCLAIM DEED
The City of Bangor, a municipal corporation located in Bangor, Penobscot
County, Maine, as Grantor, for consideration paid, releases to Dale A. Ruopp, of Bangor,
Penobscot County, Maine, as Grantee, a certain lot or parcel of land together with any
improvements thereon situate in Bangor, Penobscot County, Maine, more particularly
described as follows, viz:
Beginning in the northwesterly sideline of Holland Street at an iron rod set, being
located N 35° 03' 48" E, a distance of 75.00 feet from an granite monument found
in the southerly corner of land now or formerly of Dale A. Harmon, as described
in a deed recorded Volume 4075, page 211;
Thence S 35° 03' 48" W by and along Holland Street, a distance of 8.21 feet to a
point in the easterly corner of said land of Harmon;
Thence N 54° 56' 12" W by and along said land of Harmon, a distance of 214.50
feet to a 1" iron bolt found in the southeasterly line of land now or formerly of
JRG Properties, Inc.., as described in Volume 5301, Page 277;
Thence N 35° 03' 48" E by and along said land of JGR Properties Inc., a distance
of 8.21 feet to an iron rod set;
Thence S 54° 56' 12" E through the land of the Grantor, a distance of 214.50 feet
to the point of beginning;
Containing 1761.0 square feet, 0.04 acres.
Bearings referenced herein are oriented to Magnetic North, as determined by a survey
conducted by Plisga & Day, Land Surveyors.
For the Grantor's source of title reference is made to Volume 12505, Page 227.
All iron rods set referenced herein are capped 3/4" rebar stamped "Plisga & Day P.L.S.
2383".
Any and all other rights, easements, privileges and appurtenances belonging to the
granted estate are hereby conveyed.
All public easements or other public interests in the described premises for roads, sewers,
or other purposes are expressly reserved.
