ORDER, Public Hearing on Proposed Amendment to Bangor City Charter, Article III, Section 1, School Committee — Line Item Budget Veto By the City Owndl of the Oty of Bangw. ORDERED, THAT an amendment to the Bangor City Charter to provide that the Bangor City Council have the ability to exercise line item veto authority over the School Committee's budget should be considered. THAT the City Clerk is hereby authorized and directed, pursuant to Title 30-A M.R.S.A. Sections 2104, to provide for published notice of a public hearing to be held on July 28, 2014 at 7:30 p.m. in the City Council Chambers for the purpose of considering the proposed amendment to the Bangor City Charter, the text of said proposed amendment and an explanation thereof being as follows: ARTICLE III School Committee **Sec. 1. Powers and Duties. The members of the School Committee shall have all the powers and perform all the duties in regard to the care and management of the public schools of the City of Bangor, which are now or may hereafter be conferred and imposed upon School Committees by the laws of the State of Maine, except as otherwise provided in this Charter. They shall elect a Superintendent of Schools for a term not to exceed five years, who shall have the care and supervision of said public schools under their direction, and act as secretary of their Board; and they shall fix the Superintendent's salary. They shall annually furnish to the City Council an estimate in detail of the several sums required during the ensuing municipal year for the support of public schools. The school budget shall also include the School Committee's recommended aapropriation for each of the followina line item categories of proposed expenditures. the sum of which shall constitute the total proposed appropriation for school purposes: beginning with school fiscal year 2015. the School Committee shall submit the budget for school fiscal year 2015 and years thereafter in the following line item format: i 1. Extra and Co -Curricular activities The City Council. after reviewing the proposed budget may change the proposed appropriation in any of the above line item categories prior to approving the final budget. Approval of the school budget shall fix the appropriation for each of the line item categories and the School Committee shall not authorize the transfer of approved amounts from one line item category to another without prior approval of the City Council. The expenditures included within each line item category shall be consistent with the accounting and reporting requirements of the Maine State Department of Education and Cultural Services. The City Council may not by ordinance create additional line item categories within the school budget. On the basis of such estimates, ensuing municipal year-, and su The appropriation approved by the City Council shall not be exceeded, except by consent of the City Council, but the expenditure of said appropriation shall be under the direction and control of the School Committee and be it further ORDERED, THAT pursuant to 30-A M.R.S.A. Sections 2104 (6) and 2105 (2), the form of the question submitted to the voters shall be as follows: QUESTION (CITY CHARTER AMENDMENT) "Shall the proposed City Charter Amendment summarized below be approved and adopted by the City of Bangor?" "Summary: The proposed amendment to Article III, Section 1 of the City Charter would provide the Bangor City Council with annual line item veto authority over eleven defined categories of the School Committee's budget for the support of the public schools." The City Clerk is hereby directed to take all necessary action consistent with this Order. STATEMENT OF FACT: Additions to the existing Charter provisions are underlined and deletions are struekt#eagh. The intent of this amendment is to give the Bangor City Council line item veto authority over the School Committee budget.
