The Sheridan Corporation was the low bidder. The City's ability to execute the contract with Sheridan Corporation is dependent upon funding from sources in addition to the City, including AIP, PFC and the Transportation Safety Administration (TSA). Due to the complexity of the funding for this project, additional time is required beyond what was allowed for in the bid specifications to review the costs submitted and the allocated funding sources. It is in the best interest of the City to continue to review the submitted bid and work on the value engineering process until a final determination can be made. This Order, if approved, will authorize the City Manager to execute a contract with Sheridan Corporation for the construction and renovation project at Bangor International Airport for a contract price not to exceed $10,999,990.00. The contract will include a provision that the City may terminate the contract if funding for the project is not satisfactory to the City and that Sheridan Corporation shall continue the value engineering process and begin evaluation of final design criteria but that it shall do no work without the expressed written consent of the City as to the nature and scope of the work. ORDER, Authorizing Execution of Contract with The Sheridan Corporation — Bangor International Airport WHEREAS, the City of Bangor solicited bids for a construction and renovation project at Bangor International Airport; and WHEREAS, Sheridan Corporation submitted the low bid in their proposal dated July 30, 2014 with plans and specifications; and WHEREAS, The Citys ability to execute the contract with Sheridan Corporation is dependent upon ensuring that adequate funding is available by funding source (i.e. Airport Improvement Plan Grants, Passenger Facility Charges and Transportation Security Administration (TSA) Grant; and WHEREAS, the bid submission only requires the contractor to hold its pricing for a defined period of time and due to the complexity of the funding associated with this project additional time is required to finalize the breakdown and pursue additional grant funding if needed; and WHEREAS, it is in the best interest of the parties to continue to work on the value engineering process for the project at a cost not to exceed $50,000; and WHEREAS, Sheridan Corporation is aware that if there is not adequate grant funding available, the City may terminate the contract and would be liable for up to $50,000 in value engineering work as approved by the City; and WHEREAS, if adequate grant funding is available, Sheridan Corporation will not be compensated for any value engineering services.
